pls help po atty. qualified theft po kaso ko nov 2012 po sabi sa prosecutors office makati antayin nalang desisyon eh natatakot po ako mag follow up kasi baka bigla nila ako kulong ano gagawin ko po. worth 30k po yung sinabi ninakaw ko set up lang po lahat to sabi po ng imbistigador may chance ma dismis pero mayaman po kalaban ko...di ko po alam gagawin ko kasi wala na po ako pambayad abogado para tulungan ako kaya di ko po alam pano malalaman result at kung wanted na po ako ngayon.

You need to defend yourself, if you do not have the financial capacity, Under R. A. 9406, the Public Attorneys Office shall independently discharge its mandate to render, free of charge, legal representation, assistance and counselling to indigent persons in criminal, civil, labor, administrative and other quasi-judicial cases. In the exigency of the service, the PAO may be called upon by proper government authorities to render such service to other persons, subject to existing laws, rules and regulations.”

Itatanong ko po sana kung ano po pwede ko pong gawin. nag rent po ako ng car last feb 2010, naging 3rd man po ako dahil may nakilala ako na naghahanap ng rent a car at ako ang kumuha, naging maganda ang transaction po namin ng taong kinuhanan ko, same year ng month ng june di ko na makontak ung taong pinagbigyan ko ng sasakyan so nireport ko sa rent a car company. advice sa akin bayaran ko daw sila ng 200k para sa down ng kotse para maayos na and then sila na daw mag aayos sa bangko at insurance dahil under sa name nila ung kotse. binigyan po nila ako ng deed of sale with assumption of mortgage at sabi oras na maayos nila sa bangko at insurance pwede daw nila ibalik kahit 30% ng binayad ko. dahil naging panatag na ako, kinuha ko po ng deed of sale at di na rn napanotaryo. ngaun 2013 po biglang nagpadala po sila ng letter na nagsasabi isauli ko daw po ung kotse at bayaran ko daw po ung renta ng 48 every month since 2010 po or mag fifile po sila ng case. Sir / Maam sana matulungan nyo po ako. Thanks!

To mr jd888 salamat po sa reply nyo pero lumapit po ako sa pao nung inquest at sinabi po bayaran nalang yung 30k di po ako pumayag kasi di ko naman po ginawa at gusto din po ng pao na aminin ko nalang para mabilis kaya po nawalan ako tiwala sa pao. sobrang laki na po nagastos ko sa abogado ko. Puede po ba na mag ipon muna ako pera at saka ko nalang harapin kaso ko. nasa rtc na po ba kaya ngayon yun ang kaso? at natatakot po ako kumuha ng nbi kasi baka ikulong nila ako agad pag kumuha ako.

Hindi ka pwedeng damputin ng basta-basta, the Law Enforcement Unit of your area (Police) shall have a Warrant for your Arrest, or else your council can file a Motion to Quash if arrest is not done legally. When an arrest warrant is issued, the suspect named on the warrant can be arrested at anytime, anywhere an officer notices them. It doesn’t matter what they are doing at the time. An arrest warrant is not always served by law enforcement officials right away. Outstanding arrest warrants are arrest warrants that have yet to be served by law enforcement officials.An arrest warrant is a warrant granted by a judge in a court of law to a law enforcement official granting that law enforcement official the right and ability to arrest a person of interest regarding a crime. An arrest warrant is acquired in a court of law by presenting a judge with probable cause for arresting the suspect. If there is any pertinent evidence that can be presented to the judge when requesting an arrest warrant that will speed up the process then it should be disclosed. That is why many officers or prosecutors make sure they have probable cause and at least two pieces of evidence to present to the judge before requesting an arrest warrant. Arrest warrants are most commonly required when a crime is committed out of view of a police officer. If a felony is committed in view of a police officer then an arrest can be made without a warrant.

Now, if you will ask about Warrantless Arrest, kindly refer below:

Under Section 5, Rule 113 of the Revised Rules of Criminal Procedure, a peace officer or a private person may, without a warrant, arrest a person:

(a) When, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense;

(b) When an offense has in fact just been committed, and he has personal knowledge of facts indicating that the person to be arrested has committed it; and

(c) When the person to be arrested is a prisoner who has escaped from a penal establishment or place where he is serving final judgment or temporarily confined while his case is pending, or has escaped while being transferred from one confinement to another.

DO NOT BE AFRAID; DO THE THINGS YOU DO NORMALLY. A Clear conscience never fears midnight knocking.
