i work on a call center company. im only 2 months in the company and it's a project based account. a policy that they have is that you can only have 2 absences a month, i got sick and was absent 2days (got a medical certificate) and 1day for a sudden fever(dont have a med cert since my team leader said its ok not to have if its only 1day absent) and both of this instances happened in a month. after the notice to explain and admin hearing, they decided to terminate me. is this a valid ground for illegal dismissal?

Are still under probationary period? I dont know if tama din to pero as far as i know pag probationary pa the company has all the right to terminate your contract anytime or that can be 1 of the grounds for non regularization compare sa regular employee may mga 1st offense, 2nd offense and 3rd offense for due process purposes bago ma term.

as a rule, illegal dismissal yan. kc para maging ground ng termination ang pagliban, ang gawain na ito ay dapat kagimbal-gimbal, hindi kauna-unawa, at palagiang ginawa ng empleyado. sa kaso, mo ang tatlong beses na hindi pagpasok ay hindi pa kagimbal-gimbal at hindi naman palagiang ginagawa.

Subalit, dapat mo pa din suriin ang iyong kontrata, at iyong kilatising mabuti kung ano ang nilalaman nito dahil ito pa din ang magsisilbing batas ninyo ng employer mo. Duda nga ni kabatas Jonabelle, baka daw ikaw ay probationary employee... at dahil doon sa loob ng probationary period mo, napagtanto ng employer mo na, pagkatapos mong timbangin, ikaw ay kulang.

project based po ung account, so wala pong regularization, so sa pagkakaalam ko e hindi din kami probationary dahil sa project based po ay we are as good as regular employee pero hindi po kami makakatanggap ng benefits ng regular employee. (like separation pay). ang security of tenure po ay 2 years po so pag natapos e wala na.

para mas maunawaan mo ang iyong karapatan, i gogel mo ang Art 288 ng Labor Code. Kung may oras ka, pumunta ka sa National Bookstore sa mga shopping mall, basahin mo ang libro ni Azucena, Poquiz at iba pang batikan na mga eksperto sa labor. tipo naman kasing matalino ka kaya hindi ka mahihirapn sa pag-unawa sa batas. ang batas naman ay napaka-simple lang...

lahat ng mabuti, yan ang tama. at kung nasa tama ka, kakampi mo dapat ang batas.

nasa labor na po ung kaso, if settlement po mga magkano ang fair na price? kasi baka tumagal po ang kaso e meron pong non-compete non-solicitation agreement e hindi po ako makaapply sa ibang call center as of the moment e mejo nagigipit na sa gastusin. rough estimate po mga magkano ang karapat dapat na bayaran nila?

2 months ka pa lang.. kahit manalo ka.. ma swerte nang makakuha ka nang 1 month's salary.. pero matagal yan.. baka more than pa dyan ang magastos mo..

ano kung 2 months pa lang ako? sinusukat ba sa tenure ang damages na kailangan bayaran kung illegally dismissed? merong non-compete at non-solicitation sa kontrata so hindi ako makaapply sa ibang call center dahil dito dahil baka ako pa mapenalize. hindi ba un included sa damages na need bayaran? 2 years ang kontrata so if tinerminate ka at illegal dismissal ito e hindi ba ito nagiging breach of contract?

***additional question- if you were hired by a company at ikaw ay dineploy sa isang illegal na trabaho ng hindi mo naman alam na illegal pala ang ginagawa nyo, anong klaseng krimen po iyon? meron bang ganung criminal case?
