I am working in a call center company when last November 17, 2012, our account was pulled out. We were all placed on CTO status. We were told the company will attempt to place us on other accounts when the need arises and that for a period of 6 months ang maximum na itatagal ng CTO. As early as 5th month daw sasabihan kami if wala talaga pwede paglagyan sa amin and dun lang daw kami babayaran ng severance pay.

Ang question ko is paano po ang magiging computation ng severance pay namin? Will it be based sa # of months na naka CTO kami? Ang sinabi po nila before is 1 month worth of pay lang po ang ibabayad ng company kahit na umabot na ng almost 6 months ung employee sa kakaantay. Iyon po ba ang tamang process? Kung yung taong na-suspend pag na-absolve sa case binabayaran ung # of days na na-suspend sha, hindi din po ba applicable ito sa mga taong na CTO since hindi naman nila fault yun?

Is it legal for this company na ganun nga ang gawin habang umaasa ang mga empleyado na mabayaran sila sa # of months na walang pumasok na income sa kanila? Hindi din namin maintindihan bakit kailangan nila pahabain ng ganun katagal when it would be better na nagbigay na lang sila ng 1 month worth of pay and di na kami pag antayin ng ganitong katagal.

kasi alam naman nila di kayo tatagal nang 5 months na wlang trabaho.. so maghahanap at maghahanap kayo nang trabaho.. tapos pag ni issue yung return to work.. may iba na kayong work.. so hindi na kayo makakabalik.. so iteterminate na lang nila kayo w/o paying you kasi kasalanan nyo yun di na kayo nakabalik..

Payment to you (assuming walang mahanap na other positions in the company) would be equivalent to a maximum of 1 month salary for every year of service. That's a last option only after exhausting efforts to find a new account for you.
