ask ko lng po kung anu po dapat gawin kse yung tita ko meron syang kinakasama at yung guy married na. pero yung guy more than 15 yrs na cla di nagsasama ng asawa and never tlga cla nagsama. bfore magsama yung tita q at yung guy, meron p ms nauna kinasama dti yun guy. pero ngaun matagal n cla ng tita q. at ngayon ung guy na stroke, ts naghhabol yung asawa nya. pero never nmn nag alaga sa tuwing na sstroke yung guy. ts un tita q yung sumasagot sa pgpapagamot ng guy. pero nun nsa sound ind pa yung guy, nagsulat na xa ng last will na yung tita q lng ang my karapatan s lahat pti sa bangkay nya. paano po ba yun?

Regarding diyan sa Last Will na iyan, in general, people have a freedom of disposition that allows them to give away anything during life or after death, and to decide who will get it and in what form. People may decide to give more to those who offered better companionship or to those who are needier, or to favored charities. Now, it is very difficult here in the Philippines because in the case of the late Cong. Ignacio "Iggy" Arroyo, the Legal Wife went after everything even though Cong. Arroyo made it clear on his Last Will that another person will enjoy his remaining fortune. The point here is that, the LEGAL WIFE may go after other parties if she see it fit.

Sabi sa Art. 1028 ng Civil Code. The prohibitions mentioned in article 739, concerning donations inter vivos shall apply to testamentary provisions.

Sabi naman ng Art. 739. The following donations shall be void:

(1) Those made between persons who were guilty of adultery or concubinage at the time of the donation;

Therefore, the married guy na kinakasama ng tita mo ay hindi pwedeng magbigay ng kahit ano at kahit magkano sa tita mo. It is because under our laws, she is considered a party to concubinage. Kahit sya ang nag-alaga sa lalaki at nagsakripisyo para dito sa panahon na may sakit ung lalaki. Dura lex sed lex. The law is harsh, but that is the law.

thank you! paano nmn po yung naipundar ng tita ko at tito ko. may habol pa ba yung legal wife doon? kahit po ba mahigit pa sa 15 yrs na hindi nagsasama ang mag-asawa ay walang pdeng laban doon?

ask ko lng po regarding sa estafa case, yung friend ko po kasi nakasuhan ng estafa case. nagkaroon na po ng agreement na babayaran po yung utang every 30th of the month pero minsan po hindi on time nakakabayad yung friend q pero gnun pa man hinuhulugan pa din po yung utang khit minsan nddelay sa araw.
sa totoo lmg po, yung utang po na yun is hndi gnun kalaki.. ginawa ng complainant is nag dagdag pa ng 5yrs of interest kaya lumaki ng gnun kse ayw mkipag agreement kpg walang interest. anu po ba ang legal advice n pde po ninyo maibigay? thank u!
