@underDoghubby, my friend, did you try getting them an NSO Authenticated Birth Certificate? We know that the Local Civil Registrar forwards the records to the Census, but have you tried getting one for your kids? I asked this because Children conceived and born out of a valid marriage are illegitimate, unless otherwise provided in the Family Code (Art. 165, F. C.), and if they will cross-check with records of parents, that is when the problem arises.

The following are illegitimate children:

Children born to couples who are not legally married or of common-law marriages;

Children born of incestuous marriages;

Children born bigamous marriages;

Children born of adulterous relations between parents;

Children born of marriages void for reason of public policy under Art 38 of the Family Code;

Children born of couples below 18, whether there are married (which married is void) or not; and

Children born of other void marriages under Art. 15 unless otherwise provided. (OCRG Cir. No. 89-13 dated July 17, 1989)

kaming dalawa NG KA LIVE-IN ang nakalagay na parents duon sa birth certificate ng mga bata na nakuha namin sa civil registry. Kaya lang ang problema ko ay ito:

NAKALAGAY SA SA BIRTH CERTIFICATE NG MGA BATA AY MARRIED KAMI KAHIT HINDI. PANO TO? GAWA LANG SA RECTO UNG married liscence namin

The marriage does not exist and the BC will be questioned or invalidated should the Cross Checking will be carried out at NSO. If you will requests for your Children's BC and it has been processed accordingly; Then, their Civil Registry System (CRS) database has no copy of the document pertaining your Marriage. They would therefore require further re-verification at the paper/microfilm archives of the National Statistics Office (NSO) to determine if a paper/microfilm copy of the document exists. Re-verification entails manual search and retrieval and may take approximately ten (10) to fifteen (15) working days after the processing date. This is an additional service rendered by NSO free-of-charge, but if they will not find your Marriage Certificate / Contract, their BC will be NOT VALID.

RA 9048 allows these corrections:
You may carry out necessary corrective measures right away, go to the Local Civil Registrar and point out your issues. The more you are truthful, the more they are convinced that you are willing to correct the matter at hand.

They may require you to produce Affidavits as attachment (The usual stuffs) for Correction of clerical or typographical errors in an entry in civil registry documents, except corrections involving the change in sex, age, nationality and status of a person.

You may be required to execute Affidavit of Acknowledgement/ Affidavit of Admission of Paternity.

(A clerical or typographical error refers to an obvious mistake committed in clerical work, either in writing, copying, transcribing, or typing an entry in the civil register that is harmless and innocuous, such as a misspelled name or misspelled place of birth and the like, and can be corrected or changed only by reference to other existing record or records.)

The point being, GO there now and ask politely.

....sabi nila kakasuhan daw kami kasi nag falsify kami ng documents, like fake marriage contract..kung totoo ito. ANO PWEDE KO MAGAWA SA NGAYON PARA MAIWASAN ITO?

This is difficult but you need to carry out corrective measures for this; it is bad to presume through hearsay that you will be liable for falsification of public documents since the MC supplied is from RECTO, yet we will not dismiss the possibility of it. The advise I would give is really find somebody with extra-curricular abilities at the Office of Civil Registrar and try to work things out, if you know what I mean.

But first, please kindly Request an NSO copies of their BCs then we will see what we can do. P.M. for any result. I may have few ideas to share.

pakasalan mo yung ka liv-in mo. its the best way para maiwasan ang case ng falsification of doc. isa na din itong mahusay na paraan to win her back. sabihin mo. nahaharap kayu sa kasong falsification of doc at "echegaray" ang hatol. sabihin mo for both of you escape to this matter? gawing maka totohanan ang kasal nyo.

@underDoghubby, for the time being I don't see any complication rising from the NSO Docs, given that you have it already. Use it, keep it and tell no one, unless you have got the urge to make things right... I believe what you have now will do the tricks.

syempre sa ngaun ay wala....sa work nya ay married ang declaration nya using my last name...simula nung nagkagulo kami... nagsubmit sya ng CENOMAR sa work nya...
