good day atty, kahapon po kasi nagattend ako ng case conference for termination kasama doon ang team leader ko isang co-worker, operations supervisor, operations manager at ung employee relations officer. diniscuss po doon kung bakit ako nasa case conference at bakit for termination na ako pero hindi ko po naramdaman ang fair treatment dahil sa una palang hindi ko alam bakit sa dami namin ako ang inunang tanggalin at base daw sa metrics namin pero pagtitignan hindi ako ang pinakamababa.we have a shared file all employees can see their current ranking. dahil hindi alam talaga ng employee relations kung paano ang operation sa department namin pinaexplain ko sa mga boss ko nanandoon pero iba iba ang sinasabi nila at nung pinacheck ko ung file namin para makita ng employee relations pero nagrefused silang gawin un, para sakin un nalang ang proof o evidence ko na hindi dapat ako ang tanggalin nila pero tinaggihan nila ipakita un.recorded po ang naganap na case con.

nafeel ko na hindi fair ang ginawang case con kaya kahit for investigation pa daw sabi ko magreresign nlng ako at sabi ng employee relations mga boss ko na raw kausapin ko. pagkatapos ng case con agad ako nagsubmit ng resignation letter kahit hand written lang inaccept naman agad ng operations manager namin. Meron po ba akong pwedeng ireklamo laban sa kanila? salamat po.

bakit ka nagsubmit nang resignation?? eh di lalabas resigned ka..

dapat you let them terminate you.. then nag file ka nang illegal dismissal lalo na kung may proof ka na hindi ikaw yung pinakamababa..

Good Day!

May I ask kung meron po bang expiration yung offense if ever na hindi mabigyan ng penalty? Actually I have a co-worker na gumawa ng offense last April 2012 which is falsification of documents ito yung fake na timecard na ginawa nya at pinasa nya sa payroll dept. hindi nabayaran ang mga time card na iyon.siyempre may mga kumalat na gumawa sya ng ghost employee. but dahil sa maganda at effective ang performance nya sa company nagbigay sya ng letter na kapag inulit nya ito ay kusa na syang aalis ng kumpanya at pinagbigyan sya ng Chairman at ng HR Director. but nitong November 28,2012 nakarating sa President ng Company yung nangyari at ginawa ng president bigla syang tinanggal agad agad without letter of termination and pinagresign nalang sya ng HR Manager kaya sya nagpasa ng resignation letter para may makuha syang separation pay at yung binigay nila sakin is 13 days lang na separation dapat po ba 1 month instead na 13 days?. may habol pa po ba yung friend ko na makabalik ng Company. if you resign, mahirap nang habulin yun.. buti nga may binigay pa.. pag resigned kasi companies are not obliged to give separation pay..

dapat pag alam nyong may mali.. wag kayong papayag na resigned kayo.. let them terminate you.. kung walang due process.. you can file a case of illegal dismissal..

pag nag resign kayo.. lalabas sa inyo nanggaling yung initiative.. ano pa makakaso nyo non?

hindi ba pwede cause nung resignation ung illegal dismisal ..
grabeng insulto at humiliation inabot ko sa kanila at pagbalik ko sa production ako pinaguusapan mga co workers though ramdam ko sympathy nila sakin at iba sinabi pa na nauna ka pa sakin dahil alam nila mas mababa stats nila kaysa sakin..

at sabi kasi ng team leader ng hindi na ko bumalik sa desk ko na baka iterminate for job abandonment kaya pinagawan nlng ako ng hand wrtn resignation lttr.

at indicated naman sa resignation letter na i resigned bec i lost confidience in the management for their unfair treatment & refusing me to present my evidences tapos inaccept at pinirmahan ng management hindi ba pwede gamitin ung proof?
