I just want to share my experience po at para humingi na rin ng advice sa inyo. may nangutang po sa akin na kakilala ng fren ko. sa unang halaga ay 20k at nag issue po sya ng cheke sa akin matapos ko ibigay ang cash na hinihiram nya.at nangakong na ibibigay nya sa akin ang kasulatan ng sasakyan nya. tapos nasundan pa yun ng 18k sabi nya sa katapusan ng october last year 2012 ko ideposit yung check tapos nung magkatapusan n ng buwan nagtext ako na idedeposit ko na at sumagot sya na wag muna i cash na lng daw nya tapos umabot na ang katapusan ng november hindi pa rin nagbabayad. ang ginawa ko gumawa ako na kasulatan na pirmado nya nagkasundo kmi dati na may interst na 8% yung inutang nya. pinirmahan naman nya at nag down ng 10k nung 2nd week of December 2012 next payment daw nya befor mag xmas hanggang ngaun wala pa din sya nadagdag sa down nya nasa akin pa rin yung cheke. ano po kaya ang magandang aksyon ko... tanging ang drivers license, pirmadong kasunduan at yung issued check nya..may negosyo naman sya na tailoring. balak ko din magsiumbong sa BIR kc malamang Hindi sya nagbabayad ng Buwis.

i recommend filing a small claims case. rules on sc.judiciary.gov.ph

send a demand letter, and if you both live in qc, a complaint at the bgy.

note that that if the interest is above 3% a month, the court will reduce it to 1% a month, but the principal should be paid in full.
