good pm po atty. ang problem po may unang gf po ang asawa ko at may anak po silang babae pero hindi po sila kasal nung ex nya, pero nakapirma po ang husband ko sa birth certificate ng baby, nauna pong nag asawa yung ex nya kaya noon pong 2 years old yung baby nag file po ng case yung ex gf nya for child support, pero ang reklamo ng husband ko nung po kasi pinupuntahan nya yung bata sa bahay ng ex nya sabi ng ex gf nya hindi nya raw po nya anak yung bata kaya wag na raw po nyang puntahan yung baby, kaya po ang nag suggest ang husband ko for DNA test para malaman nya kung anak nya talaga yung baby kc may 3rd party din po nung maghiwalay sila ng ex nya tapos po binalikan nya ulit noon ang husband ko dahil ang husband ko po daw ang ama ng kanyang dinadala nya tinanggap po ulit sya ng husband sa kabila ng pakikipag relasyon nya sa iba,sinuportahan po ng husband ko noon ang pagbubuntis hanggang sa pinanganak ang baby pero po nung sinabi po ng ex nya na hindi nya anak yung baby itinigil po ng husband ko ang suporta sa bata at nagkanda utang pa po ang husband ko dahil sa babai na yon para masustentuhan lang ang bata, at nang naka handa na po ang lahat for DNA test pumunta po yuing babae sa municipal hall para i withdraw ang kaso, ayaw daw po kasi nya masaktan ang baby sa DNA test, after 7 years nagpadala na naman sya ng subpeona for child support at umattend yung husband ko, nagusap po sila sa brgy at may taga DSWD kumausap sa kanila, at sinabi ng husband ko na ipa DNA ang bata at hati sila sa gastos pumayag naman po yung ex nya na hati sila at nung pinapunta po sila sa PAO umayaw pong bigla yung babae sayang po daw kasi ang pera gagastusin nya sa DNA pagkatapos po ang PAO pinabalik po sila ulit sa brgy ngunit umalis agad yung ex nya hindi na nya hinintay ang sasabihin ng brgy. ano pong mas magandang gawin ayaw po kasi nya maghati sila sa DNA sayang po daw yung pera nya,at dun sa pag ayaw nya sa DNA gusto nya husband ko lahat ng gagastos samantalang sya naman po ang naghahabol, sana po matulungan nyo ako at para alam po namin ang dapat gawin.. maraming salamat po

Your husband recognized the child as his on the Birth Certificate. As such, he may be compelled to give support to the child. This is in accordance with Article 195 of the Family Code of the Philippines which reads as follows:

“Art. 195 Subject to the provisions of the succeeding articles, the following are obliged to support each other to the whole extent set forth in the preceding article: xxx

(4) Parents and their illegitimate children and the legitimate and illegitimate children of the latter; and xxx”

In the Absence of DNA Test which is as of this posting worth about 15,000 Pesos in some clinics.
