Gusto ko pong humingi ng advice, I am separated with my husband for more than 8 years. Kinasal po kami June 2004 and after a month nag hiwalay na po kami, umuwi na po ako sa bahay ng parents ko after non nawalan na kami ng communication ng husband ko. Nabalitaan ko na lang po na may kinasama na syang iba at nag kaanak pa siya ng 2 don sa babae. Wala din po akong natanggap na financial support para sa anak ko. Ngayon po I'm working as OFW dito sa UAE at yong ex-husband ko naman ay nasa Malaysia. Paano po ang gagawin ko para ma-process yong annulment the fact na parehas kami outside the Philippines?

Legally speaking, that cannot be done, as a rule BOTH parties MUST appear during commencement of the litigation particularly during PRE-TRIAL, otherwise, the case would be dismissed.

I would suggest na mag appear ka or kau during Pre-trial lang, kahit absent ka na or kau during subsequent hearings, let the lawyer work for that.

What if, ako lang mag attend ng pre-trial pero hindi yong kabilang party at di maki pag cooperate may chance pa din ba na ma-process yong annulment?
