Hi!

Mahirap na po magbackread and wala naman po sumasagot sa mga previously posted topics dito so I created a new one. Thanks.

I just want to ask if we are covered by the Rent Control Act.

We live in Los Banos, Laguna and we're paying 8k rent and we don't have a lease agreement/contract with them kasi di naman kami pinapirma. Tinanong na namin yung part na yun nung bago pa lang kami, never naman namin nakita ang contract kahit sabi nila meron naman silang ibibigay na copy sa amin to sign. So more on verbal agreement lang ang setup namin.

When we started living here around 5 years ago, the rent was 7,500 until March last year when the caretaker told us that the owner, who lived in the US instructed her to increase the rent for all apartments in our compound. At that time, kami na lang po yung pinakamatagal na nag-stay dito. Nagpalitan na po ng mga naka-upa sa ibang doors. So every palit ng tenant, increase sila which we know is ok lang naman. Pero madami silang improvements na ginawa sila sa ibang apartment like fixed the ceilings and tiles of the CRs and the sink. Pero sa amin, di daw sila makapag-ayos kasi nandun pa nga daw kami. So ok fine, tiis-tiis na lang sa old tiles namin.

Pero unang pinagtakhan namin ay yung ayaw nilang ibawas sa rent namin yung pag-replace namin nung doorknobs na sinira ng magnanakaw (buti hindi kami nanakawan nun). Kahit nga mga pagpapalit ng fixtures like yung mga socket ng ilaw, outlet ng kuryente, and pagpapaayos ng bara ng drain namin, kami pa din ang sasagot sa bayad ng nagpunta dun para ayusin yon. Hindi ba dapat sila ang bahala dun at kasama yun sa rental? Di rin nila ibinawas sa rent namin yung ginastos namin para sa nag-repair and sa mga socket and outlets?

Tapos earlier today, dumating na naman yung caretaker, sabi daw sa kanya ng may-ari kelangan daw ulit mag-increase ng rent. I wasn't sure if it was an increase by another 500 pesos or by 1k (di po ako sure kasi yung housemate ko po yung kausap nya). Then when my housemate brought up the issue nga nag-increase na wala pa din naman improvement sa bahay, sabi nya na kasi nandito pa nga daw kami kaya di sila makapagpagawa ng mga bagay-bagay. Pinapaayos namin yung ilalim ng sink, yung lababo mismo, at yung tiles sa CR. Sabi nya mag-papagawa nga sya pero increase na nga daw talaga ang rent by another 2k kung magkakaganon.

So ayun na nga, covered na po ba kami ng Rent Control Act or not? Pwede po ba sila mag-increase arbitrarily kasi wala nga naman kaming written contract? Or mag-follow yun na 7% yearly increase?

I haven't seen a copy of the IRR so I wouldn't know sll details. Thanks.
