Extra Judicial, kailangan pumirma lahat ng mga kapatid mo. Judicial or sa Court, u need to Prove it na sayo talaga ipinamana. Otherwise, lahat ng mga kapatid mo ay may karapatan sa Property na naiwan ng magulang nyo.

Capital gains tax is a tax imposed on the capital gains presumed to have been realized by the seller from the sale of the property. Thus, CGT should be for the account of the seller.

wala po kasing binabanggit sa batas tungkol sa pagmamana ng bunso. Ang binabanggit lang ay mga voluntary or compulsory heirs o tagpagmana at isa nga doon ay ang mga anak. At may proseso po na sinusunod sa pagmamana dahil ito ay may kaukulang buwis na binabayaran bago mailagay sa kanyang pangalan ang titulo.

Good day po,

Gusto ko lang po malaman kung ano po dapat ko gawin para makuha ko na ung title sa binili kong lupa sa probinsya, ang siste po, napagkasunduan ng magkakapatid na ibenta ung lupang minana nila sa ama nila, so imbes na sa kanila ipangalan, dinirekta na sa amin, nagkaron lang po kami ng kasulatan sa bayad kasi wala pa silang mabigay na deed of sale kasi hindi pa gawa ung pag sub-divide ng title, hindi pa daw kumpleto ang bayad ng ibang kapatid kaya hindi matapos tapos ang paglilipat, so pano po pwede kong gawin? meron po kaming pinirmahan na deed of sale pero hindi pa notarized. Please enlighten me para paasikaso ko na po to ng personal....

Nakapangalan pa po sa tatay nung nagbenta, pero binigyan naman po kami ng copy na nakapirma silang magkakapatid na pumapayag na ibenta ung mga parte nila sa lupa, eh kaso 4 years na rin po hindi pa rin nalilipat kasi hindi pa daw bayad ung ibang kapatid dun sa nag aayos ng papers. Posible po ba na kung kayanin ung kulang ng ibang kapatid eh abonohan ko muna pero ako hahawak ng title ng lupa nila hanggang makabayad sila sakin para lang makuha ko na ung title

lahat ba ng lupa covered ng title ay nabili mo?kung kapiraso lang,dapat nga magkaroon ng subdivision plan yung buong lote para malaman kung alin yung nabenta sa yo at pwde mo ipa register yung deed of sale para macancel sa mother title yung parte na nabenta sa yo based on the subd plan, and a TCT may now be issued to you for your purchased lot.

Hi,

We have a case here..

The owner consent his son to sell his share. The daughters said that their mom will not sign the contract. As for them it was a conjugal property. Their father inherited the land and the title goes like "married to"..

We dont know how to proceed. Deed of sale has been processed already.

> If we give initial payment even if the title is not yet ready will it be void if their mother will not sign?

> Do we really need their mother's signature?

If the father inherited the property during the marriage, then that is his exclusive property. He may dispose of it by himself especially if the title is under his name. A deed of sale between him and the buyer is valid.

I could have sworn I sent my issue earlier. Dunno what happened.

Anyway, I have a similar case. In a 5 ha land, 4 hindi na mabawi dahil tenanted. Isa lang ang title, and in the name of our father who passed away some 30 yrs ago.

The remaining 1 ha was "pawned" (is this the right term?)by 4 of the heirs (exluding me and the youngest bec we don't live in the area). Some 7 years had passed and hindi na nakuha dahil wala silang pambayad. Yong naprendahan lang ang nabubuhay Smile, so I decided to pay myself the pawn money and I got the prime agric lot back. I also thought it wise to just buy the property instead, and so I gave each of the heirs their share (minus the money I paid to the naprendahan).

Because there's no extra judicial partition yet, I still do not have the title transferred to my name. All 6 of us heirs are in our 40s, so I suggested that we do extra judicial partition (we have other properties 5-door apartment included). 5 of us are willing except the one abroad (in fact, she was the reason why the lot was pawned in the first place). She wants to audit up to the last centavo all the proceeds since our parents died. It's advantageous to me since I haven't also received a single cent ever. I'm practical, however. I want to avoid sakit sa ulo, suggest equal share, and just move on.

How do we move from here? If we go judicial, who's to file a case first? I figure the one abroad because she's the only one questioning everything? She's most welcome to file a judicial partition. However, considering that she comes to Phil once in 5-10 years, where will this lead us? Buhay pa kaya kami by the time the judicial case is settled? Smile

Gud pm po!Im newbie here, my tanong po ako. Bibili po sana kami ng lupa at nkpgbigay na kami ng reservation fee, huli ko nlng po nlaman na ung lupa ngkakaso pero nanalo nman sila kya lng hndi pa nailipat sa pngalan nila ung titulo. Ang sabi po ng ngbebenta eh ako po ang mgpapagawa ng titulo, binigyan po nila ako nung papers tungkol sa pagkapanalo nila sa korte saka ng tct pero sa pngalan pa ng iba. Kung bibilhin po namin un, ano po ba ang mga dapat kung gawin? pwede po bang ibenta na nila un kahit wala pa sa name nila? yung tct po n bngay sakin sumusukat ng 28,000sq.meter, kung sakali po bilhin namin ung 1000sq.meter, anu po process nun sa pgpapagawa ng titulo sa pangalan namin?ung lupa po nila my subdivision plan na at na-survey narin. At ang gusto pa nila eh bayaran ko daw yung survey, tama po ba yun? sana masagot nio po tanong ko, maraming salamat...

kailangan may katibayan na sa kanila yung property kasi nakapangalan sa iba. dapat naka specify sa subdivision plan yung 1,000.isasubmit sa LRA/registry of deeds ang approved subd plan and copy ng sellers title.yung bayad sa survey dapat sila magbayad nun kc sila magpapasubdivide ng property nila at nasa pangalan nila yung subdivision plan.pro pwede nyo pag-usapan siguro yan.

thank you po sa pgsagot sa tanong ko. Meron po silang subdivision plan at nka-specify po doon yung lupa na binibili namin, ang hindi ko lang po alam kung na-approved na yun sa LRA/Register of Deeds ung plan na yun. Paano po ba malaman kung naipasa na nila yun sa LRA o sa Register of Deeds, my kailangan ba akong hingiin na kopya o document tungkol dun? Yung title po eh sa ibang tao parin nkapangalan, pero my binigay po silang xerox copy ng deed of quitclaim and renunciation of rights, patunay na po ba yun na sa kanila na nga talga ung lupa?

i think pwede na yun.Land management bureau ng DENR ang nag aapprove ng subd plan.tingnan mu lang yung copy ng subd plan kung may pirma ng denr land management section.

Wala pong ganung section sa subd plan. Ang naklagay lang eh yung nag-design sa property, geodetic eng., title ska ung location lang po. Pero pgdating sa denr land management section, walang nakalagay.Ibig po ba sabihin nun hindi pa nila pinapasa un? thank you...
