ask ko lang po ano maganda gawin sa case na to. A doctor issued post dated checks kasi naginvest kami sa coop nila. ok naman nung una pero ngayon wala na pondo yung account. the doctor tells us na babayaran niya na lang yung principal amount paunti-unti. pumayag kami. pero hanggang ngayon wala pa siya binibigay kahit singko. ang principal amount na kailangan niya bayaran a akin is Php200k. madami pa s ibang mga doctor. ngayon hindi na siya sumasagot sa mga text messages at tawag. I also found out na meron livelihood foundation ang pamilya nila. hindi kaya ginamit nila yung mga pera. tnx for your advice.

where are the checks now? did you try to deposit them? are they now stale?

you can try to deposit the checks and then file a case of bp 22 against him.

it may be better to proceed first by sending a demand letter. good luck.

what should i do next if she still refuses to pay me after sending the demand letter?

moderator
if you live in the same city, file a complaint at the bgy level first. if not proceed to file a criminal complaint at the prosecutor's office.

What if they don't live in the same barangay? Where would she file a case against the borrower? We have the same problem. Thank you

If you live in the same town or city you have to seek first the intervention of the Barangay for conciliatory proceedings.. or if in different cities or towns and you live in adjacent barangays, you need the barangay..

If no settlement is reached, then you may now file a case for BP22..

sweet,not same barangay, but same city or municipality. if not, they can go straight to the prosecutor's office.

help, it is not necessary, but later you may be asked to provide proof of receipt. you can trace also with the post office if it was delivered and ask them to issue a certification.

Good PM po isa po akong retiree one year na po meron po akong officemate na nang hiram sa akin ng pera last August 2009, hiningan ko po siya ng cheke post dated po para ihuhulog ko na lang sa account ko yong check at ang sabi ko na interesan yong utang at nangako po na babayaran ako nung Dec 2009. Pero hangang ngayon po hindi pa po niya nababayaran ang kanyang utang ang ginagawa lang po niya hulugan ng interest ang kanyang utang. 3% po ang interest at ang kanyang utang niya 50k e dahil po ako ay nagpapagawa ng bahay mula sa aking retirement e ngayon po talagang kailangan ko na po ang aking pera kaso puro lang po pangako ang ginagawa niya hangang nitong august 10 ang sabi niya sa txt na pagbigyan ko hangang friday at may iniintay daw siyang pero kaya inakala ko po na na pondohan na niya yong account niya nung August 13 friday kaya deposit ko na po yong kasi po ala na akon pambili ng materiales sa pinagagawa kong bahay. 1sang taon na po yong utang niya at d niya ako masisisi dahil lagi ko siyang sinasabihan na pondohan na niya at ide deposit ko na pero lagi siyang naki kiusap pero nitong huli na ang sabi nga niya na hangang friday ayon dineposit ko kaso nag bouce po yong cheke hangang ngayon ala siyang sinasabi tungkol sa cheke na nag bounce ngayon po ang tanong ko ano po ba ang legal action na puede kong gawin tungkol sa bouncing check at puede ko rin ba siyang ireklamo sa umbudsman?

help, that depends on which lawyer you retain.

sansui, i don't recommend the ombudsman. you are gov't employees? i recommend filing a small claim. rules are on sc.judiciary.gov.ph. you won't need a lawyer. good luck.
