Question lang po. Yung company na pinapasukan ko (bpo) previously had an attendance policy where in employees were given a certain number of points tapos pag nag absent or ma late ka babawasan yung points na pinag simulan mo. Now, hindi yun na bantayan ng management so yung iba nag negative na pero wala pa ding kaso. Implemented yung policy na yun sinula nung nag start yung company. Ngayon dahil malala na yung issue, pinaluran nila yung policy. Ang problema hindi lahat ng empleyado ay nag start sa pareparehong sanction... Yung mga negative yung points binigyan ng final written warning agad tapos isng absent eh 2 days na agad. Question, legal po ba yung ganong changes sa policy? Given na hindi naman fault ng empleyado n napabayaan nila ung lumang policy. Note: pinirmahan ko ung new policy. Thanks

Legal and Valid, management prerogative po yun. Regardless nag pirma ka dun sa new policy or hinde sakop ka rin noon.

It is the employers fault na napabayaan nila yung company policy nila, likewise, it is the employer will impose that policy and not the employees.

Thanks for the reply. Smile follow up question natkasakit ako for one day and was able to present a valid med cert tapos i was given meds.. Yung doctor hindi ako binigyan ng days of rest so yung med cert is only the day na hindi ako naka pasok... So pumasok ako kinabukasan and the day after tapos sumama yung pakiramdam ko ulit and hindi nakapasok.. I was suspended fir 2days kasi hindi na ko nag pa tingin friday kasi ako nag absent and i was still taking meds prescribed by my doctor so nung weekends ok na ko... Tama ba na sinuspend nila ko kahit na may justifiable cause naman.. Thanks.

Tama ang pagsuspend. At your point of view, there is a justifiable cause to make absences, kasi nga nagkasakit ka, however, on the employers side, yung pag absent mo is valid only nung nagkasakit ka with the med cert as issued by the doctor. Since yung subsequent absences mo, walang med cert ka na pinakita to justify your absences, then it is just and proper for the employer to suspend you.
