good morning po. nakatira mo kami sa land ng lola ko po. matagal ng patay ang lola ko. meron pong written authorization siya mismo ang nagsulat na ang papa ko ang mag babayad ng tax dito sa lupa. may naka pag sabi po sa amin ng pwede daw ma transfer ang title sa pangalan ng nagbubuhis kapag ilang taon ng nagbuhis instead of sa owner. how many years will it take para ma trabsfer na po sa amin yung title .? currently po 13 years na kaming nagbubuhis. thank you

Wala pong ganun sa batas, maybe yung sinabi sa inyo is thru "prescription"- by which through past of time, magiging kayo na yung owner ng property. But then "prescription" will not apply in your case kasi merong lawful owner yung property, which is your lola.

Now, since your lola is now deceased, your father ALREADY acquire that property through "Succession", subject to the rules on co-ownership(just in case, may maga kapatid father mo, hati-hati sila sa property).

In order to transfer that property to your father, your father may institute a judicial or extra-judicial partition, para sa ganun, matransfer yung titile sa father mo and sya na talaga ang nagmamay-ari ng property or a portion thereof(in case of co-ownership).

Since 1972 pa po namatay yung land owner. actually po, great great grandma siya ng father ko. Si great great grandmother po nakapangalan ang lupa. Yung nag bigay sa father ko ng authorization, great grandma na yun ng father ko at siya na lang yung principal owner that time. Ngayon po, patay na sila lahat. Wala ng nag aasikaso sa lupa nato. Kami lang yun pinag bubuhis nila dito. Ni search ko yung sinabi nyong prescription, ano po bang ibig sabihin nun? Maraming salamat po. Sana matulungan nyo po ako.

Alam mo it doesnt mean na kung kayo yung nagbubuwis or nagbabayad ng real property tax over the property eh, mapapasa inyo na yan by lapse of time, hinde po ganun yun. Sa tingin ko mapapasa inyo yang lupa by reason of succession (minana nyo from your father, lola, great lola.

Yung "prescription" naman legal term po yun, hinde po yan yung papel na binigay ng doctor na nakasaad ang gamot and the frequency of taking, hinde ganun yun.

Prescription is one of the modes of acquiring ownership whether real or personal property through passage of time. Eto ay isang pamamaraan para matransfer ang ownerhip ng isang bagay paglipas ng ilang taon.

Succession is also one of the modes in acquiring ownership, for short eto ay yung tinatawag na "mana" mula sa ascendants, ninuno natin.

Sa tingin ko in your case, you aquire that property through succession. hinde po pwede dyan ang prescription kasi nga merong nag mamayari sa lupa, yung ninunu, ascendants mo.

If UNTITLED, well pwede na patitulohan, just present the tax declaration as one of the proof, marami pa requirements yan for OCT.

ung titled, pwede ba un mapasakanila un tru prescription? (yup, transfer nga ng title) halimbawang, meron ibang co-oner na walang paki?

No, because of the rule on imprescriptibility of title.

Yung sa co-owner naman ibang issue naman yun, hinde mo pwedeng i-disregard yung OTHER co-owners regardless walang paki sila or merong paki, because later on, magkaproblema kayo dyan sa division, UNLESS the co-owner WAIVES/SELL/DONATED his/her right of dominion over the property owned in common.

isang tanong na lang, so ang dapat na gagawin halimbawang may co-oner para mapasakanila ng buo ang lupa ni great grandma ay papaexecutin nila ng waiver or deed of sale/donation un ibang co-oners, aderwise talagang in existence ang co-ownership magpakailanman?

kung ito kasi ang sitwasyon, malamang maging magulo ang mundo ng pamilyang iyan sa paglipas ng panahon. sa property kasi, kadalasan, hindi totoo ang "d mur d merrier", d ba? mas maganda kung ikaw lang ang magmamay-ari sa iyong prperty. so dapat kung wla ng paki ung iba, halimbawang tinayuan mo na ng bahay ung lupa hindi pa din umumik ung co-oner mo, mas maayos kung ang batas e sasabihin na dpat sau na.

Thank you so much for the clarity sir tsi ming choi and pedro parkero. Now we know the co-owners regardless if they care about the property or not, they needed to waive something to prove that if in case they dont really care. At least the future generation in the family wouldnt be in chaos because of this.
