good evening. been married for 22years & been separated for 7years from 2001-2008 due to husbands irresponsibility. got married due to an unexpected pregnancy, medyo complicated & no need to elaborate. got back together last 2008, my personal reason is for my kids future kasi mag college na sila pareho & nagkataon nasa abroad si hubby. thought of accepting him again kahit di ako 100% sure na mahal ko talaga sia. i already said to myself na i would rather grow old alone than to live with him again. kinain ko ung sinabi ko kasi napilitan ako makipagbalikan just for my kids future. unfortunately, mahirap pala talaga ipilit ang hindi pwede. we had a major misunderstanding last January which led to another separation though nasa abroad pa rin sia. we argued thru phone, text & emails. marami na siyang nasabi na below the belt against me pero ok lang. my problem now is he discontinued his support. we have a condo unit which is under bank financing thru auto debit. hindi na sia nagpadala ng pambayad sa amortization ng Feb & wala ng balak pang magpadala pa. my dilemma now is the amortization payment. inutusan nia ako na humanap ng buyer pero panu mabebenta ang unit kung may prob sa bank? i tried to explain this to him pero dedma lang. hindi na rin nagpapadala ng pambayad sa mga bills. binibigyan lng ng allowance ang 2 bata, pwede po ba na un lang ang responsibilidad nia eh ang laki laki ng kinikita nia? please help panu ako makakuha ng support sa kanya. am working pero kulang po pambayad ang sweldo ko sa lahat ng bayarin namin. hope to hear from u soon. thanks.

send a demand letter for higher support then you can escalate to a civil complaint for increase of support. you can also risk a criminal case of economic abuse

Hi Sir,
Greetings! I am from baguio city and i am concerned about the marital status of my sis-in-law. She got married last december 2011 to a resident of Laguna. He is working there in manila and only comes up to visit every month ...only for three consecutive months and not more than a week of stay. There after has never come up to baguio anymore and is always verbally abusing my sis-in-law thru text.after 6 months, september 2012 he came up to baguio to pay a visit but ended up a fight with my sis-in-law accusing her of a lot of things that we can prove she did not do. after that, he never come in contact with my sis-in-law ever again till to this date. used to be, he only sends 2k for her allowance but since march 2012 to present, there are no financial support or whatsoever coming from the guy anymore except for abusive words sent thru text messages. not only he says obstructive words but also character assassinates his wife almost to family members. he has totally abandoned his responsibilities to his wife. May we ask what is the best possible solution for this matter? My sis-in-law tried to give him chances but he somewhat has a behavior that is really disturbing. because of such, we are having thoughts of him having an affair with someone else at the same time turned to a drug addict? We are grateful for your advise and thoughts about this.

ano po b ang karapatan ko bilang legal wife kase ung naanakan ng mister ko e nagdedemand ng support,.ano po b ang pde kong gawin para mapangalagaan ko ang trabaho ng mister ko as seaman kase ung girl pumupunta ng owwa at poea para magpadala ng letter regarding s suporta s anak nya..e natatakot lang po ako n baka maapektuhan ang trabaho ng mister ko dahil s ginagawa samin nung grl,pti feeling ko nilalagay nya kami s kahihiyan dahil s ginagawa nyang pagsulat s mga employer ng mister ko,ano po b dapat kong gawin if she file a case against me and my husband?sana po matulungan nyo ko..salamat po

pati nananakot rin po syang hindi daw makakaalis ang mister ko,.umatend po kami s 1st mediation conference last week.,kaso hindi po nagkasundo s amount kase po mas mataas ang gustong amount nung nanay kesa s amount n kaya ng mister ko,nalaman nya kase n nagincrease ung salary ng mister ko e dati naman po kuntento lang sya s nabibigay namin,.ano po bang dapat namin gawin?kase my 2nd conference p po,pano po kapag ngmatigas p rin sya s gusto nyang amount?..sana po maliwanagan nyo kami at sa karapatan kong ipagtanggol ang mister ko bilang legal wife..

ellein, what conference is this? at poea? imo, as long as you are giving a decent amount, then the poea cannot compel him to give any larger or to stop him from working.

mediation conference po 2nd part,.kase po hindi pumayag ung grl nung 1st meeting so sabi po nung atty.my 2nd conference p dw po until 3rd,.kapag hindi p rin nagkasundo its up to them kung isasampa n dw po s court nung girl,now my question is..may laban po b kami just in case iakyat nya sa korte?pati kung s pao lawyer sila lumapit pde rin po b kaming mag pao lawyer?at wala po bang babayaran sila kung kapag inakyat nila s korte ung kaso through pao lawyer or pao help?pati my percentage rin po syang hinahabol s mister ko,totoo po bang may ganun?,e unfare naman po ata un para saming legal n pamilya nya di ba po????natatakot po ako n baka wala kaming laban kapag nagkaharap n s korte at baka matuloy ung pananakot nyang hindi makaalis ang asawa ko,.pls..need ur help po..tnx po in advance..

anong kaso po b ang pwede kong ilaban s girl as a legal wife sa mga pananakot nyang hindi makakaalis ang asawa ko at sa mga paninira nya na ginagawa gamit ang social networking site(ex.facebook)????.(ex.hindi dw nagbibigay mister ko since birth.)kaso ang mali lang po namin nung nagbibigay kami wala pong pirmahang naganap kaya wla kaming mapapatunayang ngbibigay kami,e baka kase baligtarin kami nung grl n wala tlg kaming binibigay...pls po pakipayuhan naman po ako,,salamat..god bless..

to threaten to take legal action is not a crime.

but if you want to pursue a case, you can file a complaint for monetary damages against the girl for interfering in your married life. and case for libel, if the evidence warrants

Good Afternoon sir,
I would like to seek some advise regarding my case R.A. 9262 sec 5 (e)(2).I was accused by my wife regarding this article law of non supporting my children.My story goes like this I am an OFW currently working in riyadh, I went on vacation last may of 2012.then by that time we did have a quarrel between me and my wife regarding marital problems of accusing me of having an affair.then 1 month after i flew back in riyadh for the purposes of coming back to work.by then after 1 month of coming back i send money to her for remittance. at first they were communicating on me with regards of sending money.after a while on the next following month i keep on sending money remittance directly to her up to the third month until such time that suddenly they stop communicating with me,ignoring my calls and text on which i am asking if they receive the money but no reply,until such time that i recognize that she is not settling all the financial obligation at the schools for my kids and other bank obligation on which we already discussed to settle all this through my remittance monthly.then i decided to ask a favor to my parents for whom i handed over the remittance for the purpose of fulfilling my financial obligation with my children,schools, and banks.then i ask them to hand over the money to my wife with a supporting papers on signature to be sure that if ever she filled a case against me i have evidence that my remittance and financial support is continuous despite the fact that she is denying it until such time she filled a case against me of non supporting my children after 3 months of she intentionally stop communicating with me and also my kids they started to hide from me.I didn't know that she file a complaint against me although my support is continuous up to present.she filled case on the address eventually that we are not living there anymore since i was in abroad.she deals my case internally within her relatives address. knowing that she knew were we really lives during that time the problem was happens. my parent also didn't know about that case only by hearsay that we knew that i have been accused guilty of the crime only this January 2013 i knew about it and the case was filled Sept 2012 and i already have a warrant of arrest waiting for me. and have a bail bond ...my question is is there any possibilities for me to answer such accusation which is not true? can i present all my receipt in remittance to my mother and the paper she sign in getting the money as evidence? What is the chances of being acquit of the case? is my way of sending money through my parents is acceptable with a valid reasons? Is it right for me to continue my support assuming that i was judged as guilty without any notice from them? Can u refer me to a good lawyer to deal my case? I am still here abroad can i act or do something in order for me to start arranging the case while i am here? whats the first step to do pls. do send me reply thank you and waiting for response which can help me ease my problem..

about my case is the courts reserves the right to stop me from working and put me in jail in case they don't want support instead only they need is to put me in jail due to anger.do they have the right to do that knowing for the that they already accused me.

nold, if i were your lawyer, and i could show that the notices were never sent to a proper address so you could be notified to answer the charges, i would file a motion for reinvestigation, but it has to be done within 10 days of confirmation of the existence of the case.

good day po..ask ko lang po ano po bang pwedeng mangyari kase po hindi po ako nakaattend ng hearing now sa court about child support kase po wala pong nagsabi sakin n may hearing now o kahit anong letter n pinadala kaya wala po kong alam,,ano po bang mangyayari at may laban po b ako kase po ayw pong pumayag nung grl s amount n kaya kong ibigay gusto nya mas mataas,e hindi ko po kaya un,.kaya dineretso nya s korte ung kaso,.may laban po b ako?hindi ko naman tatakbuhan obligasyon s bata,.kaso hindi ko kaya ung amount n gusto nya.,hindi po kami kasal,.at matagal ng hiwalay,.kaya sya gnyan kase nalaman nyang nagaabroad n ako kaya now naghahabol sya,.pls need advice po,.salamat po

so how do you know tht there was a hearing if you didn't receive a notice? is this in court or at the prosecutor's office?

bali tinext lang po ng kuya ko sakin,.pero po nagkaron n kami ng agreement now na magbibigay n po ako ng support monthly,.kase ang nakalagay po sa agreement ay kapag nagstop o hindi nasunod ung halagang napgusapan e irerefile dw po nya ung kasong criminal or r.a. 9262..ang tanong ko po e pde po ba nyang irefile ung kasong un,e may katibayan naman po ako na nagbibigay ako ng support..makakasuhan pa rin po b ako ng criminal case or magiging civil case nalang?kase ang iniiwasan ko po ay ung makasuhan ako ng criminal case..maari po bng magrefile sya ng criminal case against me?salamat po..
