Hi there. I hope somebody can help me. Annulled na po ako, we have a kid, nasa akin po ang bata, pero nasa province, while ako, andito sa Manila, working. Ang decision po ng court eto: shared custody,visitation rights, 5,000 pesos support without increment up to college. Ang situation po ganito, ako andito sa Manila, nagwowork, ang bata nasa amin sa probinsya, umuuwi lang po ako sa amin everymonth. Ang exhusband ko po, di nya magawa ang visitation rights nya kasi nasa probinsya ang bata, ayaw nya magpunta. Ngayon po, can I file a case against him sa di nya pag support sa bata kahit ang shared custody ay di namin nagagawa? Thank you very much for reading my post.

gud day po.i have a 15 years old daughter and is now on her first year college this coming school opening. Her father and me were not married.He didnt even have a sign of her birth certificate although when im having my false labor he still accompany me in the hospital, but unfortunately, when the day that i actually gave birth, hes gone. He told me that he will just got to inform to his parents that im having my labor, but sad to say he didint come back anymore. For 12 years we didnt have a communication although he knew that we had a daughter. Last 2 years ago,he called. he said that he was searching for us and that he still dreamed na mapunan daw nia ang mga pagkukulang nia samin. Nangako sya nun na magpapadala sya. kahit na sinabi ko lng pabiro na kung pwede umutang sa kanya..Magpapadala daw sya at da daw utang yun kundi para sa bata. Pero hanggang ngayon,wala pa rin kahit isang kusing akonng natatanggap. Dna sya tumawag pgkatapos nung pangakong binitawan nia. kinokontak ko yung number na ginamit nia pero, nagrring lang at d nmn sya nag ccall back. nagmessage ako sa kanya sa profile ng anak ko para humingi ng tulong nung maoperahan ang annak namin, pero bnlock na nia yung anak ko..wala akong trabaho ngayon at nahhirapan na ako lalot mag ccollege na ang anak ko. ang pension lng ng mother ko ang inaasahan nmin. ayaw na ng ank ko na makiusap pa sa ama nia pra humingi ng tulong dahil sa gnawa nia. pero gusto ko magbigay namn sya kahit konti lang, d ko nmn sya inoobliga, gusto ko lang makahingi ng tulong lalot wala akong trabaho..pano po gagawin ko. nahhirapan na rin akong maghanap ng trabaho dhil hindi nmn po ako graduate at isa pa mejo my edad na rin po ako. ano po bng dapat kong gawin.? ang isa pa po, ang apelyido ng anak ko ay yung apelyido ko,parehas po kami pati middle name, kasi po sabi po sakin nung inayos ko po birth certficate nia, mahirapan daw po ako pag wala daw po akong ilalagay na middle name ng bata. wala po akong ibang naisip kaya yun sa nanay ko na lng po ang ginamit ko. kaya parang lumalabas po magkapatid lang po kami. tulungan nyo namn po sana ako ano at pano dapat kong gawin. salamat po.

ellein, obviously there's a case, but it's not clear what stage you are in the proceedings. hopefully she filed an affidavit of desistance so the case cannot be revived.

redk, yes, because custody and support are not dependent on each other.

dynh, college at 15, wow. the proper remedy would be to file a petition in court for correction of entry. on the other hand you can jut continue to use her name as stated on the birth certificate

kaso po ang gumawa po nung motion for withdrawal e ung prosecutor,.so ibig nyo pong sabihin,kahit n nagbibigay ako ng support dun sa grl e pde pa rin nyang ikaso ung criminal case na kinaso nya sakin?or irefile ung kaso???

dynh, that is a petition filed in court to correct the entries in the birth certificate.

ellein, i recommend you get a copy of that withdrawal. if that's true then it is unlikely that it can be revived, but she can file a new case if you do not give support

kilan dapat magkakaroon ng Rights o Rights mag-file ng petition sa kinauukolan na tanongin ang anak which is 7 years old at the moment kung saan siya gustong sumama o tumera, sa mother o father as illegitimate child otherwise known as from a Live-In parents? bali ako yung father...

dyn, if the father signed the birth cert, then you can immediately demand support.

andre, only the mother has legal right to custody of an illegit child.

he ddnt deny that she is our daughter but he didnt sign any because he didnt already come back when i gave birth. thats why i dont know what to do to ask his support.

then you can't. your will have to consider filing a court petition to prove that he is the father and compel him to provide support.

andre, to contest her right, you'll have to file a case and convince the court that it is in the child's interest to be with you. very tough though.

anyway what are the offenses or acts by a mother that could forfeits her custody to the child?

last 2010, my 8 year live-in partner doubtfully had a relationship with an arab guy, she goes home to Philippines pregnant para mag-palaglag... and tinangap ko parin sya just for the sake of our daughter.. recently, sya pa ang nakipag-hiwalay..

need advise in favor sa child custody... thank you!

i asked him personally then e told me he would give me support until such time that he boarded a cruise ship and work there, he never contacted me and he refused to give anymore support. can i file a case?
