yung property ng lolo ko po ay naremata kase sinanla sa banko ng 6 sa 10 nyang anak at hindi na natubos. My Lolo already passed away last 2008. Ang gusto ng aking tatay ay bilhin sa banko (fyi - di sya kasama sa pagsasanla nung lupa dati) ang tanong ko po:

1.) Tama ba na humingi pa ng payment ung 2 anak na nakasama ung bahay nila na tinayo dun sa pagremata? (Isa sa kanila ang ngsanla ng property)

2.) Malalaki kase yung hinihingi nilang payment, nung nalaman nila na interesado kmi na bilhin. pwede ba sabihin sa banko na huwag ipaalam sa kanila na tatay ko ang bumili? Kase tama po ba in reality if 3rd party ang bumili wala sila dapat makukuha?

Foreclosed na ung property bakit hihingi ng payment ung 2 anak na nakasama at nagsanla ng property.
Your father can buy the property without prejudice to the the original owners because the property is now owned by a third party (bank). The original owners cannot demand payment as they do not have ownership over the property.

Actually po yung 2 na yun nagtayo sila ng bahay bago pa maisanla sa banko. Si bro. #1 since di raw sya kasama sa pagsasanla eh humihingi ng bayad dun sa bahay nya. Si bro #2 kasama sya sa pagsasanla pero ang gusto nya bilhin yung lupa na kinatatayuan ng bahay nya. Medyo naguguluhan po kami sa set up na ganyan since my father is already 71 y/o and most of us na children nya are working abroad so inaalala namin parang gusto pa sys isahan ng mga kapatid nya. Since usapan na kamag anak eto would it be possible na maitago sa knila kung sino ang bumili ng lupa? If ever na ilihim na lang nmn sa knila na binili nmn ung lupa? Can we ask the bank to hide the identity of the buyer? (Til such time na kapag medyo hupa na eh sabihin n lng nmn n binili ulit dun sa buyer?)

Or kumuha kami ng dummy tas tska ipalipat yung deed of sale sa name ng father?

Sa totoo lang po ayaw ko na sana bilhin ni tatay yung lupa kase nga parang magulo. Kya lang, he really wanted na mabawi ung property kase me sentimental value sa kanya yun kc pundar ng magulang nya. But, it would be unfair on his part na me naghahabol pa na kung tutuusin wala na dapat.

no need to get a dummy, it is sufficient that your dad buys it from the bank. and dapat mangyari dian, your dad should demand to the bank to eject those not lawfully owners of the property. kumbaga squatter, an unlawful detainer will suffice.
so what do you worry if your dad bought the property? would her brothers go after him and say something bad?
