yung company na pinapasukan ko nirequired kami mag mandatory ot during our rest day to do preventive maintenance service sa tool. sa palagay ko po justified naman yung dahilan. kaya lang di po ako certified sa trabaho na yun at ang company namin ay may strict policy sa certification compliance.

so kinausap ko po yung supervisor ko kung pwede umuwi na lang ako kase di ko pwede gawin yung pinapagawa nila or else i will be penalize. sabi nya hindi daw pwede kase mandatory ot daw yun. tinanong ko kung ano gagawin ko. ang sabi nya mag "housekeeping" na lang ako. ang sabi ko po kung ma explain nya base sa labor code na yung housekeeping ay ma justify yung necessity for mandatory ot i will comply, else i will exercise my right for a rest day. ang reply nung supervisor:

"...wag mo nga ko pagpipilosopohen! anung law ka dyan? kung gusto ko patayuin kita or paupuin kita maghapon, di ka pwede umuwe, mandatory nga eh".

dahil napansin ko na di na siya makikinig sa reason at ayoko naman mapahiya or umabot sa malala yung sitwasyun, umalis po ako. pinababalik nya ako at sinabi bibigyan nya ko disciplinary action. punta sana ako sa HR kaya lang rest day ng HR nun kase linggo.

insubordination ba yung ginawa ko? thanks

imo, yes, it is insubordination, but not so grave as to warrant termination

salamat po sa pagsagot.

tanong ko lang po kung valid po ba yung argument ko.

na kung okay na tanungin ng employee yung superior para sa valid na dahilan kung bakit siya kailangan magtrabaho sa rest day base sa labor code at kung di nila masagot maaari bang tanggihan ng employee yung pumasok ng overtime na di siya bibigyan ng penalty or ituturing na insubordinate?

ang ibig ko po sabihin kung lawful order po ba yung magrequire ang employer ng mandatory rest day overtime ng walang valid reason/reasonable explanation base sa labor code?

at kung lalabas na willful disobedience yung ginawa ko, kung and dahilan ko po kaya ako nagwalkout ay to avoid further confrontation and personal humiliation?

here's how i look at it, that's a good argument to raise in your position paper if you are terminated. but it may make more sense and more safe to render OT then file a complaint after.

Marami po salamat sa pagsagot.

nakikita ko po ang practical value ng inyo pong suggestion, kaya lang di ko na po magagawa sa dahilan lumipas na po yung araw na kailangan mag OT.

sa tingin ko po naman yung management is sensible enough na di ako i-terminate, kaya lang ayaw ko din ma bigyan ng disciplinary action as much as possible.

medyo nakakapagod po din kase yung trabaho namin. hanggat maaari mas gusto ko sana mag rest day para makapag pahinga, dahil lately nakakaramdam na po ako ng physical discomfort.

maraming salamat po uli.
