good day atty.:

Please advice me to my problem, I had a son to a married man.. Our son is going to be 12 yrs old. And studying in a private school.. eversince na pregnant ako 15,000 na kada buwan padala nya. 3yrs ago nag ask ako ng increase na 5,000 at give namn niya. 2 yrs ago he stopped communicating with us but the support is still there. The problem is binabaan niya ng P5000 instead na 20.000 na napag usapan namin..one year na ngayon na kulang.. iba ang padala nya sa tuition fee ng bata. Kapitan po siya ng barko at walang anak sa asawa nya. marami siya pangako na di natupad pero okey lang ang sabi ko lang po bigyan ng magandang edukasyon ang bata. Ngayon po gusto ilipat ang bata ng school at mahal daw dun sa eskwelahan niya now.. Pwede ko po ba siyang padalhan ng demand letter? delayed din po ng One and half mos ang padala nila. at ang nakikipag usap pa sa akin e yung asawa nya. Help nyo po ako at gusto ko po na ang anak ko e sa private school pa rin pumasok. grade seven na po sa pasukan. Maraming salamat atty.

Kung hindi naman niya pinapahinto ang anak mo sa pag-aaral at tinutustusan naman niya ng tama buwan-buwan, wala akong nakikitang problema dun kahit pa mailipat sa public school ang bata.

pero kaya niya pag aralin sa private school ang bata kasi kapitan siya ng barko at wala siya anak na sa tunay nyang asawa. ang sweldo niya ay napakalaki. ang hinihingi ko lang sana eh magandang school..

You can file a civil case for that. A petition para humingi ng dagdag sa financial support na ibinibigay niya para sa bata. there is no guarantee that the court will favor your request.

@ toragsoysailg yung 20k per month po ba is for monthly eexpenses lang po ba aside se tuition fee?

ngayon binaba na nila ng 15,000. oo iba yung sa tuition fee. now ayaw na nya pag aralin sa skul na dati. he earns at least 300,000 malaki na ba yun ibinibigay nya para sa bata? kulang grabe kasi ang apt namin 4,000 na ilaw tubig baon pa.

Opo atty. alam ko po na bata lang ang dapat niyang suportahan. ang hinihingi ko po sa kanya e yung pag aaral aaral ng bata sa private school. Malaki po ang sweldo niya at kaya nya paaralin ang anak niya.. ano po kaya ang pinaka maganda ko gawin? Level 7 na po ang bata at ayaw limipat ng school. salamat po ng marami.

@ toragsoysailog di ba what is important is na sesend sa school ang bata and provided naman lahat. marami naman public school na magaganda.

@ atty in this case po ba, pwedi magdemand ang mother in what school dapat magaaral ang bata since malaki ang sahod ng father or what is important is nakakapag aral ang bata and provided nmn lahat? until where po ba ang limitations ng pagdedemand ng third party to protect naman ng rights ng father?

Ang alam ko ang support e nababatay sa sweldo ng ama at kung ano ang nakasanayan ng bata. Ayaw kasi lumipat ng bata sa ibang school at nasanay na sa kanyang dating iskwelahan. I let you know Ms what will happen to my case. I went to fiscal before and told me that i can send him demand letter.. di ko pa ginawa kasi now lang talaga niya pinapalipat ng skul. thanks again..

torga, P15,000 a month is a substantial amount. if you want an increase, and i believe the child is entitled to it considering his supposed income, you will have to hire a lawyer and file a petition for court for increase of support.

Thank you very very much Atty. ito po yung hinihintay kong kasagutan.. nagkaroon ako ng lakas ng loob para mapadalan siya ng demand letter.. Salamat po ulit at sana ay marami pa kayong matulungan na mga kababayan nating may mga problema. God Bless you and your family.

pumayag na po ang ama ng anak ko na di na lumipat ng skul ang bata.. text ko lang sa kanila na ayaw lumipat ng bata. di po ako nagpadala ng demand letter.. nakapagtanong ang asawa niya sa abogado dun sa kanila. siguro napayuhan po na ituloy na lang kung ano ang dating ibinibigay ng ama.
