Pwede po bang itransfer ng brother ko sa pangalan nya ung land title na nakapangalan sakin kaya itinatago nya ung title...ayaw nya po ibigay sakin pero nasa registry of deeds na nakapangalan cya sakin don po kc cya nakatira kaya gusto nyang angkinin ung bahay at lupa

IMO, pwede pero maraming falsification ang dapat nyang gawin, gaya ng signature mo, pwede nyang palabasin na binili nya ang lote sayo at may deed of sale na pirmado mo, makakuha siya ng valid ids mo para sa execution ng deed of sale at pagpapa-notary at pag ok na ang mga taxes, bayad na, pwede na nyang i-apply para malipat sa pangalan nya ang title.

kadalasan, kailangan sa notary ang original valid ids para sa confirmation ng photo copy, sana lang mahihigpit ang mga notary public na malapitan nya

ano po pwede ko gawin para meron akong pinanghahawakan na sakin ung bahay at lupa ayaw po talaga nya ibigay yung mga documents eh kahit anong usap ang gawin ko

Ang mga magulang namin may property din pero nung namatay na di namin makita ang titulo, may nagsabi sakin na nandun sa isang half-brother ko kay tatay namin, kaya kinausap ung tao pero pinagkaila niya. Kaya, gumawa kaming magkakapatid ng Affidavit of Loss of Title bilang mga heirs, at pina annotate namin sa Register of Deeds. Sa loob ng 5 years (lagi ko check sa Register of Deeds every six months kung nanduon pa ung title para sigurado walang magpepeke ng dokumento para agawin ung title. Tapos sabi ng Register of Deeds puede raw kaming magpetition sa court upang ireconstitute/reconstruct ung title, pero ung lawyer namin sabi mga 6 months bago matapos. For scheduling na ung hearing namin sa court, nabalitaan ng tao na pinapacancel namin ung titulo, at may nagadvise sa kanya na puede siyang kasuhan ng "stealing" the title kapag wala siyang ipapakitang kasulatan kung bakit nasa kanya ung titulo. Kaya siguro natakot, kusa niyang isinurender sakin ung titulo. HINDI AKO ABOGADO, SHARE KO LANG UNG EXPERIENCE KO, baka makakatulong sa iyo. Siguro punta ka sa isang abogado at mabuting magtanong ka kung puede rin gawin ung ginawa namin. Good luck!

Proceed to the Registry of Deeds and inform them about the issue of your property and also seek an advice for what actions you are need to do in order to protect your property from disclaimer. I think RD will suggest you to make a legal document attesting you are one of the heirs and has the rights with the property, and it will be annotated on the title, so that, your brother cannot transfer the property on his name without your consent. Just be wise and alert for your brother CAN falsify the document of yours. So don't give any important documents to anyone, especially those documents with your signature.

Kung dokumento ang kailangan mo bilang panghawakan na ikaw ang may-ari ng lupa, puede ka naman kumuha ng certified true copy ng tax declarations ng lote at bahay sa local assessor's office, at magbigay ng sort of a request to them na NO OTHER COPIES SHALL BE GIVEN TO ANYONE WITHOUT YOUR WRITTEN PERMISSION, at sa Registry of Deeds ay puede ka rin kumuha ng computerized certified true copy ng title at gumawa ng Affidavit of Misplaced Torrens Title (never mentioned that you know or have an hint that your brother has it, otherwise they will not accept it) sa abogado at ipa-annotate mo sa Registry of Deeds para kahit sino i-fake man ay hindi matratransfer sa iba dahil kakailanganin ng Registry of Deeds ng another Affidavit of Recovery of Misplaced Torrens Title bago puedeng ipangalan sa kahit sino, kahit pa ikaw na mismo ang magbebenta ay kailangan mo pa rin itong affidavit of recovery. Ask ko lang, have you ever had any action to eject your brother from your own property? I think you have the right to enjoy your own property and do whatever you want to do with it...opinion ko lang!
