The land is declared in 1949 by the eldest brother of our grandmother, but prior to that, said property is also declared for taxation purposes in the name of our great grand father. During those times in their lifetime we have been sharing the fruits of the land. In 1974 said land was applied by a title by the eldest brother of our grandmother, and lately the heirs of the eldest brother of our grandmother are claiming that the lot is solely owned by their father(brother of our grandmother) and we are being denied of our share.
The brother of our grandmother was the only one left in the locality as our grandmother lived in different province, reason why he was the only one left to administer the land and for the assessor to declare the same in his name. However, at the back of the first tax declaration issued in 1949 there is a notification stating "declared in the absence of the owner".
This declaration was later applied by a title (1974) and is now the basis of their claim.
what remedies do we have to be able to assert our ownership over that land? please help us.
