Hi:

I filed a complaint to NLRC about my case (Illegal dismissal) last March 22, 2014. The amicable settlement of SEnA was not successful. I asked to be reinstated but my previous employer didn't agree.

I filed a formal case instead.We will have our hearing on April 29 and May 6.

My questions is, since my employer didn't want me to be reinstated, what other things can i ask during our conference in front of the arbiter? Can i asked for separation pay instead?

separation pay plus payment of days actually worked is normally the best you can expect.

sorry to hear that actually terminated you even if they said you were not involved in the fraud

Separation pay? That's one month salary times the the year of service right?
What do you mean about the days actually worked?

Yes, unfortunately I was terminated by my employer. Very sad. Very very sad:(

Yung April 29 at MAy 6 mo ay court hearing na sa NLRC at inde na sa SENA, tama po ba? Kung formal case ka na sa NLRC, nakasubmit ka na ng position paper at may lawyer ka na?


Kung alam mo na illegally dimissed ka withouth just causes (meaning, wala ka violation tlaga sa company), then ask for separation pay, damages, atty fees, at backpay (based sa kung kelan matatapos ang decision pabalik ng last day mo sa knila na March 22). Yan ang pwede mo idemand at makuha.

Magpapareinstate ka ba talaga? If yan na history mo sa company, then better move forward ka na lang. Otherwise, may lamat na ang inyong relasyon ng company mo.

Sabi ng lawyer Ko , parang amicable settlement Lang ulit daw po un and wala pa pong position paper na kailangan.

Hindi na po Ako magpapareinatate. Kasi ayaw na din nila.

Ahhh so mediation hearings itu ng NLRC bago ang formal na kasuhan talaga.

Yes, much better na di mo hilingin na mareinstate ka. Iprocess mo lang ang case mo, at attend the hearings para maayos sya. Company naman ang magsesettle sayo, unless me duda ka na me mahahabol pa sila sayo.

Guilty ka man or inde guilty sa kaso mo sa knila, the fact na dismissed ka, e me separation pay yun. Magiiba na lang nga ang computation.

I don't think po na may mahahabol pa sila sakin.
I have people to testify naman if kailngan na wala talaga akong kasalanan.

Be strong. Sa ngayon, important makakuha ka na rin ng work then focus lang sa cases. 30 days naman ang turn around ng NLRC dapat.

I know the feeling. Me isa ako na nasettle at nanalo na labor case last year at me dalawa pa ako now na on going.

Pero since yung 2 ay parehong illegal dismissal, at madami ako evidences, e nasa akin ang bola at paniningil ng mahal. Hehehe!

So keep the faith, God has better plans.

I suggest iprepare mo na ang computation para meron ka idea sa figure.

Iconsider mo na ang:
1. sepration pay
2. unused leaves
3. last pay
4. damages, depende na sayo yan
5. atty fees

For no due processes, alam ko 30k ang penalty dyan ng labor sa companies na inde nagpafollow.

Kung me merits ang case m, yaan mo lang kung ayaw nila magsettle. Ipush mo lang ocmplaints mo. Sila naman ang me kaso, inde ikaw. You have to know your rights kung naviolate ka, at kung anu ang dapat lang na mapasayo.

Awww....this is bad news...well, sana makapag appeal ka na...tama..10 days lang un...when po natapos ang case mo...i mean ung processes for position paper etc.? Saken kasi natapos nung Aug 29th pero until now, wala pa rin decision....saan mo nakuha ung decision? via post mail ba? or through ur lawyer na?
