Breach of Contract (employer demand more or less 1M)

ndi po ako nging masaya sa systema ng company namin. may 2years bond ako pero after 1 year umalis din ako.

ang employment bond ko is 300,000 pesos for 2 years. Hindi po ako masaya dahil tuwing may training kami may pnapirma samen na addtional bond for 1 year. tumanggi po ako.

then may training po kami ulit na kelangn namin. pnplit kami na pirmahan with another bond again. ndi ako sumama.

then i decide to resign. nagusap kami ng supervisor. sabi ko sa kanya ndi ako masaya and lagi ako ngkkskit dito (company). and sa health card nila ndi provided ang optical needs.

ngusap kmi ng mga HR, may pnapapirma sken na kelangn ko bayaran lahat ng snweldo ko sa knla. plus liquidation damage.
ndi ko po kaya yun.

sabi ko po pagiisipan ko muna, then they keep on calling to me na need nila letter ko na bbawiin ko yng resignation letter.
ndi ko po nagwa. ng awol ako. at lumipat ng company.


after 6 months. nbalitaan ko n lang na may civil case ako for breach of contract. and nakalgay dun. ang demand nila is more or less 1M, and may summon ako within 60 days. ndi po ako mkpunta dahil umalis po ako ng bansa. dito ko na po nabalitaan.
sa naintindihan ko po. pg ndi ako pumunta, judge by default ang kaso.

masyado po malaki yun Atty. ndi ko po kaya bayaran. ako lang po inaasahan ng karamihan.

marami po ako gusto itanong sainyu.
pasensya na po ndi ko inaasahan na ganito ang mangyayari. sana sagutin nyo ang mga tanong ko.


1.) posible po ba ma set-aside ang "judge by default" if ever bumalik ako in 2 year?
legal reason po ba na wala ako sa bansa?

2.) pwede po ba umangat sa crime case yng kaso ko? llitaw po ba sa record ko sa NBI ang mga gntong case?

3.) ano po ba ang magandang solution po dito. i tried to call attorney pero by appointment. ndi po ako mkpunta personal.
need ko po legal advise.

4.) Nagppadala ko ng pera sa mga savings sa bank ko. posible po ba na kunin nila lahat yun? 3 po account ko.

5.) May chance po ba na mangyari ang hold-departure saken for civil case? if umangat sa crime case, possible po din ba?
im scared, kung bblik ako. mwwalan na ko trabaho at mrami ako mbbigo.

6.) ano po ba ang pnaka worst case scenario na mangyyri if ever na ndi ko aksyonan ito.

7.) in the future, may plano po ako apply citizenship. mgkakaproblema po ba sa Phil embassy? magkkarecords din po ba dun?

wait, what do you mean, 'nabalitaan mo'?

for an amount like that, there has to be a case filed in the RTC and summons has to be served to you.

it seems to me you've been misinformed by a collection agency. if there are any docs, review them and look for what court this is supposedly filed in.

nangungupahan po kami, yng may ari nagabot ng letter sa kasama namin sa bahay.

ksama sa letter po ang summon. nagssabi na within 60days of the last publication. kelang po daw ako doon sa court.

andito na po ako sa abroad nung nabalitaan/nalaman at kakareceive lng ng ksma nmin sa bahay.

ksama po sa letter ang Summon, complaint, at mga witness po. letter din po galing sa atty ng previous company regarding my unjust resignation.

ah, they are trying to acquire jurisdiction over you even if you are outside of the country. that is a valid court process. yes, the case can continue even if you do not make any response.

no, you can not set it aside when you come back. no hold departure, but once the case reaches finality, they can ask the sheriff to find your bank accounts.

i recommend you get a lawyer who can defend you, but others sometimes just make their assets beyond reach
