On renting: health risks and violation of rights

My issue is somewhat related to pre-termination of contract. However, we do not have a written contract.

I have been renting a place here in Makati since Mar 4, 2013. Recently, i asked the lessor if i can move out on may 4 (exactly 2 months) on the following reasons:

(1) the construction of other units are ongoing. the lessor initially told me na ang gagawin lang eh ang katabing unit for 3 weeks. since im working naman daw, gagawin lang yun pag wala ako (9am to 6pm). almost 2months na, pero di pa rin natatapos hanggang sa ginawa na rin ung ibang parts ng area na wala naman sa usapan. Tpos, instead na rest day ang weekend, eh hindi rin ako makapag-rest kasi kahit weekend may gumagawa.

(2) Heath risk. Ang mahirap yung alikabok ng semento, ng pagpuputol ng tiles, pumapasok sa unit ko. Nakakaubo nga actually. Tapos kailangan ko linisin every night kasi ung alikabok kumakapit sa mga gamit. Mahirap huminga kasi ung alikabok.

(3) Hindi maganda ang ventilation. Mainit ang unit. Tapos ung likod ng aircon ng may-ari nakaharap sa unit, kya mainit.

Pumayag naman ang may ari na umalis ako on May 4. Kasi sinabi ko na nahihirapan na ko (huminga at matulog kasi maingay). Pero ayaw ibigay ung deposit ko.

Bale ang binayaran ko, 1 month advance (6k), 2 months deposit (12k). So ung 1 month advance ko, nagamit ko na nung Mar 4 to April 4. Tpos nagbayad ako ng 6k for april 4 to may 4. so meron pa kong 2 months deposit. Ayaw ibigay ung 1 month deposit. Ung other 1 month deposit lang daw ang pwede kasi consumable daw ung 1 month.

Ang reason ko, pano ko i coconsume un eh kung di na nga ko comfortable at makahinga sa tinitirhan ko kasi hanggang ngayon eh may ongoing construction.

Nabasa ko po kasi, sa New Civil Code Book 4 Title 8 Chapter 2 Section 2 – Rights and Obligations of the Lessor and the Lessee

Art. 1654. The lessor is obliged:

(1) To deliver the thing which is the object of the contract in such a condition as to render it fit for the use intended;

(3) To maintain the lessee in the peaceful and adequate enjoyment of the lease for the entire duration of the contract. (1554a)

Art. 1658. The lessee may suspend the payment of the rent in case the lessor fails to make the necessary repairs or to maintain the lessee in peaceful and adequate enjoyment of the property leased. (n)

Art. 1659. If the lessor or the lessee should not comply with the obligations set forth in Articles 1654 and 1657, the aggrieved party may ask for the rescission of the contract and indemnification for damages, or only the latter, allowing the contract to remain in force. (1556)

Art. 1660. If a dwelling place or any other building intended for human habitation is in such a condition that its use brings imminent and serious danger to life or health, the lessee may terminate the lease at once by notifying the lessor, even if at the time the contract was perfected the former knew of the dangerous condition or waived the right to rescind the lease on account of this condition. (n)

May habol pa po ba ako sa 1 month deposit ko na 6000php? Tama po ba ung pagkakaintindi ko na may karapatan ako na i-cancel ung contract ayon sa Art 1658 and 1660?
