good morning attorney!

my wife requested last april na maghiwalay na kami last april since we are no longer in harmonious relationship.. actually, more than 4 yrs na walang kibuan sa bahay..

and there's the "hinala" issue about an affair.. maraming magagalit at marami din siguro a-agree if i say na ganun talaga mga lalaki when it comes to dating other girls.. pero no serious relationships.

anyway, when she asked that we part ways, nakaharap yung 2 anak namin.. so alam nung mga bata na maghihiwalay na kami ng mommy nila.

sya na din ang naglabas ng mga gamit ko from cabinets and i left the house on the same day..

I promised that I will support the kids need in school and at home pero alam kong pati sya ay makikinabang..

i just want to know kung ano mga cover ng obligations ko?
- the house where they stay is being paid through pag-ibig.. i didn't have a decision when she chose the house.. umutang sya ng pang-down na hindi kinonsulta sa akin ang we moved there on 2004.. when she lost her job in 2009, ako na lang ang nagbabayad ng hulog sa house and wala na syang share.. with our separation, i no longer plan to pay yung mga hulog sa bahay.. tama ba yung karapatan ko na 'to? Yes I am thinking that it is for the kids pero kasama pa din sya sa makikinabang na ayaw kong mangyari..
- the bills (electrical, phones, etc).. kung hindi na ako nakatira dun, am i still burden to pay?
- foods.. naggo-grocery ako para sa mga kids pero sigurado naman na pati sya kahati dun.. nagre-request pa din panggastos na pamalengke..
- loans.. may ni-loan kami sa dati nyang amo and we pay on a monthly basis.. since ako ang nakapirma, i have no choice kundi bayaran yung utang..

Paki-tulungan nga po ako na maliwanagan kung magkano ang dapat ko isustento sa kanila.. When I was living with them, umaabot sa 34k-36k ang gastos monthly (all included pati mga credit card bills ko), pero nag-ne-net lang sa 32k-34k salary ko.. in short, hindi talaga nagpapang-abot sweldo ko..

is she still entitled na mag-demand when she asked na maghiwalay na kami? tinatawag nya pa din ang sarili nya na legal wife ko..

I intend to get my kids kasi duda ako na masusubaybayan nya kasi she's not that bright.. mababaw man pero isa yun sa ikinagalit ko sa kanya.. na kailangan pang hintayin ako ng mga bata late in the evening para maayos ang assignments nila.. kahit sya siguro, duda sa gawa nya kaya hinihintay pa ako.. meron naman computer, internet at printer sa house na magagamit nila..

I believe the kids are old enough to choose, they're 10 and 15, kung kanino nila gusto sumama..pero nagbanta sya na hindi nya daw ibibigay kahit court ang magdecide..

moderator
if you file a case for custody, you can ask the court also to fix the amount of support.

meantime,make sure you regularly give a substantial amount of support.
