My grandmother left no will and he left behind a land with the title still under her name.She has 5 surviving children, one deceased.Who automatically inherits it? Will the lot be equally divided among the surviving children only? How about the children of the deceased ? Do they have a claim on the land too? My grandmother died 1980 and until now we still don't know what will happen to the lands she owned.

I hope you could give us good advice.

Subject: Transfer of Property to Legitimate Heirs - By Inheritance
________________________________________ ______________


Glad, to be able to transfer the property left behind by your grandmother, you need to go through the legal process of:

A. Extrajudicial settlement

B. Filing of Estate Tax Return - with BIR
Payment of Estate Tax to any Authorized Accredited Bank (AAB)
of the BIR.

C. Payment of Transfer Tax - with the Assesor's Office

D. Transfer of Land Title to the names of the legitimate heirs.
(With the Register of Deeds).

E. Transfer of Tax Declaration to the names of the legitimate heirs.
(Assessor's Office).


So, nobody automatically inherits the property.
Property is divided to 5 children.
If one is dead, his children has a right to his share.
