I enrolled my 4 yr old son in a private school here in Darangan, Binangonan Rizal last May 2013. I payed P6,500 for semi-annual payment and the classes started this Monday June 17. 

The problem is there's only 2 student attended the first day of class. According to the school admin, the total enrollees for kinder is 6. But I highly doubt this. Because of the low number of enrollees for kinder the school admin suggested to merge kinder and grade 1 class session (same room, same time, same teacher, but they will have separate lesson plan).

I thought the school is showing some signs of stopping its operations mid school year since the business side is becoming unstable. So I wanted to transfer my son and get my refund on tuition payment. But the school admin wouldn't refund the payment 100%. Is this lawful? 

It has only been 2 days since the start of the class.

Please advise.

Just to give update on this for the sake of others having the same trouble and to save them time. 

I called depED Action Center (636 1663) and they honor school policy regarding refund and this issue is out of their jurisdiction. 

I even tried to send them email and got response the following day. Their response was "Private schools have internal policies regarding refund after enrollment which is beyond the jurisdiction of the Department of Education (DepEd).  Please get a copy of their school handbook which defines some policies on fees and other matters."

The response was a bit disappointing but at least I know the line of communication to depED is working.
