Dear Atty.

Isa po akong mistress.Ang partner ko po ay ikinasal 10 years na pero 1 week pa lang silang ikinasal,nagkita kami abroad,pareho po kaming OFW.Nung una pinilit kong alamin status nya pero wala akong nalaman hanggang sa naging kami,sobrang naging masayaat puno ng pagmamahalan at pagkalipas ng ilang buwan,umamin sya sakin na may asawa sya sa pinas pero di nya ito mahal,pinakasalan nya dahil buntis.

Nung nalaman ko,pilit ko syang nililet go dahil alam ko di tama pero nangibabaw pagmamahalan namin sa isa't isa at tinuloy namin,niyaya nya akong sumama sa kanya sa iisang bubong at pumayag ako.Hanggang umabot ito ng halos sampung taon at nagkaroon kami ng anak na lalaki.

Nalaman ng asawa nya sa pinas tungkol sa pagsasama namin at may anak kami pero di nya ito hiniwalayan.Ilang beses kaming nagsagutan ng asawa sa email.Pero nang mawalan ng trabaho yung asawang babae,nagpumilit sya makipaglaban at pilit nya akong pinapahiwalay sa asawa nya.

Kahit magkasama kami ng asawa nya umuuwi pa rin sya sa kanila pag birthday ng anak nila o kaya pasko.Dumating nitong June,nung inihatid ko ang anak namin galing bakasyon at pagbalik ko wala na syadahil bumalik na sa asawa nya at tanging rason nya sa akin ay ayaw nyang talikuran sya ng buong angkan nya at gusto nya try iwork out marriage nila.

Napakasakit ng ginawa nya,alam ko di ako asawa pero sa 10 years nilang kasal,kami ang nagsama ng 10 years at binigay ko lahat lahat ng pagmamahal sa kanya,ngayon bigla syang bumalik sa asawa nya dahil nakonsensya sya.Tinakot ako ng asawa nya na kasuhan ng Adultery.

Atty,pwede pa ba ako makasuhan ng Adultery na hindi na kami magkasama pero lahat ng ebidensya meron yung babaeng asawa.
Ngayon,pumunta dito sa abroad ang asawa at yun ay nagdudulot sakin ng sobrang stress dahil dito kami nagsama ng 10 taon tapos dito din sila mamalagi.Nangako ang lalaki sakin na magreresign sya at magkaknsel ng PR para matahimik ako.Gusto ko po hingan ng sustento ang anak ko na kapangalan at kaapelyido ng lalaki,may sapat akong kita para matustusan ang anak ko pero sa sakit ng ginawa nya,gagawin ko ang paghingi ng sustento,milyon po makukuha nya pag nacancel PR nya,may habol din ba anak ko dun?

Pwede ko po ba iharap sya sa cosul ng embassy para pumirma ng sustento pag nakakuha nako ng demand letter sa abogado?

Sa elligitimate ko pong anak,ilang porsyento ng sahod nya madidemand ko?At pag umuwi sya ng pilipinas at di makakuha ng trabaho,kailangan pa rin ba nyang magsustento kung makakapirma sya?

Atty,pasensya na sa mahabang sulat,halos mababaliw po ako sa ginawa nya,after 10 years na nagsama at masaya,bigla syang mang iwan dahil kagustuhan ng angkan daw nya.Salamt po ng marami.

when one speaks of criminal laws, you can only apply the ones where the acts were committed. you should consult with a lawyer where you are and inquire whether you can be held criminally liable for living in with a married man.

under philippine law, what you committed may be considered concubinage, but it should have been done in philippine territory so as far as the philippines is concerned, there was no crime that it can prosecute.

also under philippine law, adultery is committed by the married woman by having sexual relations with a man other than her husband.

also under our laws, your son has the right to demand support. failure to provide can be considered economic violence. if the man signed the birth certificate, or you have other evidence that the father acknowledged him as his son, then you will be able to establish filiation.

the amount of support depends on the needs of the child and the ability to provide support. there is no fixed percentage. you can demand this even if you are outside the philippines.

your child is not entitled to any part of this canceled PR unless the father dies. as an illegitimate child, he is entitled to half of what a legitimate child will receive as inheritance.
