Good Day!

Meron po akong kaibigan na kinasal dahil nabuntis nya daw yung girlfriend nya then after 3years yata naghiwalay sila pero simula noon tuloy parin ang sustento nya sa bata. Pero after 4years napatunayan nya sa tulong ng DNA na hindi nya pala anak yun.


1. Pwede po ba ihabla yung asawa nya at sa anong kaso?

2. Pwede narin po ba itigil ang sustento?

Malaking processo yan dahil hangga't hindi sya annul sa kasal ng babae ang surname na gagamitin na bata ay mananatiling sa kanya, meaning sa batas anak nya ito! so patuloy ang sustento hangga't ma annul ang kasal. Dahil kapag buntis ang babae at kasal sa lalaki kahit kaninong anak pa ito, ang bata ay dadalhin ang surname ng asawa ni babae. Kaya hangga't hindi pa nya napapa annul ang kasal may obligasyon sya sa bata dahil sa dinadala nito ang surname nya! pag katapos ng annulment pwede na nya ipetisyon hindi na gamitin ang kanyang surname at matitigil na rin ang demand sa sustento.

if he can prove there was concealment of the paternity of the child, he has until 5 years from the wedding date to file a case to annul the marriage
