Hi attys,

isa po akong ofw dito sa uae,..
nagsampa po ang wife ko about sa contract ko, dhil po sa contract ko dw ay single ako, nung kmi p ay ngssma lgi nya pong tinatanong skin yan bkit dw po single ang nklagay sa contract ko, at ilan beses ko rin po pinaliwanag sknya n sa visa status ko po un ibg sbhin nun ang compny po nmin ang ngbbgay non, at ibg sbhin po ng single status po sa visa nmin eh hindi maaring mgbgy ng visa pra sa pmilya ko ang compny n pinagttrabhoan ko, pinipilit ko pong ipaintindi sknya na iba ang visa status sa marital status at nakita nmn nya po na ang nklgay s pasport ko ay married ako at sa benepisyo ngagalit sya bakit dw hindi ko sya isinama sa insurance ko dhil dw single ang nilgay ko, sa insurance ko po atty mga kids ko lng po ang nillgay ko at sa tingin ko ay tama ang ginwa ko,

ngaun po atty ask ko po pano ko po malalabanan ang case na sinampa nya skin?.. hindi po ako bsta2x makakauwi ng pilipinas at hindi rin po ako uuwi dhil sbi po ng parents ko may sumon n dumting sa bhay nmin at nklgay n nsa watchlist dw ako.. atty gusto ko pong i file ang annulment nmin kso nga lng po once n umuwi ako ng pilipinas bka hindi n ako mkabalik dito sa uae

Sabi ng tatay ko bka dw pde sya ang mag-asikso ng case ko dun, maaari nga po ba na ang tatay ko ang mag-ackso ng case ko?..

what is alleged as your crime? ra 9262? when did the subpoena arrive?

you can have your lawyer prepare your affidavit and you can swear to it there before the philippine embassy or consulate then send it here.

Salamat po sa maagang reply..

sa POEA po sya ngreklamo ang kinaso nya ay ang status ng visa ko sa contract, dito ksi sa company nmin my single & family status n sinsbi, kpag mbaba p lng ang posisyong ang nklagay sa contract nmin is single status meaning po nun eh ako lng ang cover ng ng insurance company & other benefits pero kpg po tumaas n ang posisyon ng empleyado ngiging family status sya meaning nun ay kung anoman benefits ang nakukuha ko sa compny un din ang makkuha ng family ko,( i.e plane tikets, visa, & medical insurance)lahat ng sgot ng kumpanya..

at un nga po ang nireklamo nya sa POEA n ginmit ko dw ay single sa contract at hindi dw married,pti rin ung voters I.D ko ay gnwa nyang ebidensya smantalang binata p ako nun nung ngprehistro ako & till now hindi na ako nkakaboto,

... hiwalay n kami ang gusto nya ksi ay sknya mpunta ang sustento pero dhil nga hindi nga npupunta sa gastusin ng bata ang binibgay ko pinapadaan ko sa tatay ko at may pirma sila n nkktnggap ng sustento mula skin, my legal separation agreement letter n kmi at ngaun ay gumgwa p sya ng case laban skin..

Dumating un sumon last week lng po at nakalgay sa letter na may hearing ng 27th july, pero dhil nga late n dumating ang sumon hindi po ako nkpghanda para umapela.. Hindi ko rin po alam ang ggwin ko para maptunyan sknya na hindi ako nandadaya, ang pasport na ginamit ko ay married at sa owwa ko ay married pero d ko alam kung bakit nya pinagpipilitan n nandaya dw ako

Nklagay din po sa letter na black list ako,,, ask ko po atty hanggang kelan po ba ang black list sa pilipinas?.. gusto ko rin makita ang mga anak ko at maipsyal sila sa vacation ko.. at pde ko bng macheck sa website kung blacklist p rin b ako?..

i cannot claim to be fully knowledgeable in the poea rules of procedure, but i am surprised that a notice of hearing will state that you are already in the black list. is this correct?

instead of or in addition to your father, i recommend that you retain counsel to look into the case. I believe it is unlikely that the case has been submitted for resolution because normally, failure to appear in a hearing will lead to a rescheduling.

the poea black list is a list of persons who will not be processed by the poea. it is continuous until a new order is issued removing you from the list. i believe it is a penalty which is imposed on ofws who have proven violations.

now, regarding property relations, your agreement has no legal effect and it is not binding upon you and her. only a court can decree a separation of property. legally, she is a co-owner of your entire salary.

yes atty nkalagay po sa letter n nka black list ako..
pano po ba mlalamn kung nkablack list p rin ako?.. may website po ba para mlman kung nka blacklist p rin ako sa pilipinas?..

i am currently involved in a poea case involving a recruitment agency but i have to admit that I have not heard of admin cases against ofws being heard in the poea.

no, the blacklist is not posted on the net. i recommend you either send a relative or retain counsel to look into this. legal representation should not be that expensive. ignoring this will not make it go away. good luck

thanks po sa mga reply nio malaking tulong po skin ang mga sagot nyo..

anyway atty nkatanggap ako ng desistance letter galing sa wife ko na inuurong n nya ang case dhil hindi nya nmn tlga kyang ptunyan n dinya ko ang employment contract ko at isa pa po atty sa pasport ko p lng at sa owwa records ko nklgay n married ako.

Ang question ko po ngaun nsa akin n ang desistance letter galing sa knya at may poea stamp

1)pde n b akong makauwi sa pilipinas at mkakabalik din kagad dito sa uae..

2)Automatic b n wla n ang blacklist ko?

3)Pano ko po ba malalaman n original ang sinend nya sa email ko?.. kasi po bka pineke nya lang ang desistance letter, mgaling po sya ksing mameke ng papers.. gusto ko po mlaman kung may case p rin b ako sa poea?.
pde ko po b na ipachek sa city hall ksi dun sya ng file ng desistance letter at pinatatakan nya dw sa poea..

4)ung sumon sa poea mismo nya finile..dpat b n dun din sya mismo magfile ng desistance letter or ok n po ung sa munisipyo sa lugar nmin?..

She desisted without you doing anything?

These questions are best answered by sending or a representative to the POEA to verify everything. now that you mention that she may be good in faking docus, could it not be that it was all a hoax?

i recommend you send a lawyer. it should not be that expensive. pm me if you have more questions.
