Elvin Cataluna po ito. hingi lang po ako ng tulong, any help po wud be highly appreciated.

160sqm po ung kabuuang lupa ng ninang ko pro ung 100sqm (house n lot) lng po ung binebenta nya.
bale po on going n ung pgbbyad nmen s 100sqm house and lot na binebenta samin ng ninang ko.

nsa ninang ko na po ung titulo at deed of sale. kaso po hnd nya pa mpalipat sa pangalan nya dahil wla pa po xang budget. clear nmn po ung title xa s registry of deeds nung tingnan nmen.

gusto po nmen n mgkaroon kme ng Hati nang titulo. ung titulo ng lupang matitira sa ninang ko (ung 60 sqm) at ung s mbibili ko n 100sqm.

anu2 po b mga requirements pra mapahati n nmin at mgkroon ng sarisariling titulo ung lupa? mgkno kya ang mgggastos?

tska dagdag ko lng po. hinuhulugan lng po nmen ang lupa. at ang katibayan lng po na hwak ko i ung mga byad n binigay ko. at ung ninang ko i my katibyan dn n nreceive nya ung mga byad ko s ganitong date at ung amount.

need dn po b n mgkaroon ako ng copy or xerox copy ng title at deed of sale n hwak nya? although mbait nmn po ninang ko ay gusto ko lng po mksigurado.

Ung deed of sale ba napanotaryo na? Nakapagbayad na ba ng capital gains tax at documentary stamp tax sa BIR?  Kung hindi pa, at napanotaryo na ung Deed of Sale, may penalty.

Cguro ipasubdivide ng ninang mo ung lote sa 100sqms and 60 sqms sa isang geodetic surveyor.  Hindi naman kaya maging problema ang pagsubdivide at baka ung bahay ay hindi tatama sa 100 sqms?

Hindi ninyo mapapatitulo hangga't walang subdivision survey lalo na may improvement sa lote.

Magtanong ka sa DENR para ipasubdivide mo at di ako alam kung magkano? Kapag nasubdivide na puede ng gawin ung deed of sale ayon duon sa survey technical specifications. Pagkanotaryo ng bagong deed of sale, pay the capital gains tax (6%) whichever is higher sa market value sa tax declaration (in name of your ninang, and assure sa computation ng BIR sa market value ay masubtract ung maiiwan sa ninang mo) or selling price sa deed of sale or sa zonal value ng BIR ganun din sa documentary stamp tax (1.5%); kapag may Certificate Authorizing Registration (CAR) na from BIR, magbabayad ka ng Transfer Tax sa municipal treasurer (a certain percentage of 1% of whichever is higher sa market value sa tax decs o sa selling price sa deed of sale).  To register it to your name, you need the CAR, Transfer Tax receipts, certif of realty tax payment, original duplicate title (mother title in your ninang's name),receipts of payment sa BIR, Transfer Tax sa Municipal Treasurer. mga 10K sa pagregister kung computerized; Sabay ang pagpapatitulo sa 2 subdivided lots ayon sa surveyor's technical specifications niya. Kapag nakuha mo na ung title mo, ideclare mo sa pangalan mo sa assessor's office at same documentations na ibinigay mo sa Register of Deeds ay hihingin nila.

Magnegotiate ka sa ninang mo who to pay what... legally, notarial fee equally shared by buyer and seller, documentary stamp tax by buyer's account, capital gains tax at seller's account, transfer tax at buyer's account, surveyor fee at seller's account, registration and transfer of title to buyer is at buyer's account. In your case the 60 sqms of your ninang is at her own expense sa titling.
