Good Day po! meron po akong loan sa isang cooperative pero june 2012 nung nag resign ako sa trabaho ko. ngayun po nag email po saken ang dating officemate ko. sabi po nya may salary deduction daw po sila dahil po co maker ko sila sa loan ko sa cooperative. Handa nman po akong bayaran ang naiwan kong pagkakautang. ang problema ko po nung nakipag communicate po ako sa cooperative at binigyan po nila ako ng statement of account nakalagay po dun na nsa 22k po ang balance ko. mag uumpisa na po sana akong bayaran ang balance ko kaya po nag confirm po ako sa coop s amount po ng kailangan ko i settle, ang sabi po ay nasa 26k na daw po dahil nag charge pa sila ng interest at maari pa daw lumaki lalo habang hindi ko pa nababayaran ang balance ko. ito po ang tanong ko:

Your accountability with the Coop is separate from our transactions with the Co-makers. Sorry po pero yon ang reality. I'm sorry uli if I really need to mention that to you but the fact that you didn't fully pay your loan automatically you have to pay additional interest. Ngayon, para malinaw po sa inyo you need not settle your accounts to your co-makers, hindi po kau may utang sa kanila kundi sa coop po kayo may utang. Kung anuman ang responsibility namin sa co-makers nyo kami po ang magsi settle yon.Pasensya na po. If you want to settle your account, the earlier the better.


tama po ba na kahit po nabayaran na ng mga co makers ko thru salary deductions nila ang balanse ko ay hindi pa din po ako clear sa utang ko sa coop at patuloy pa din pong amg e-earn ng interest ang balanse ko. balak ko po kase sanang mag bayad nalng ng direct sa mga co makers ko sa amount na binawas sa kanila ng cooperative. kaya lang po nag aalala ako na baka po hindi ako bigyan ng certification ng cooperative na kakailanganin ko nman po para ma release ang final quit claim computation ko sa dati kong pinagttrabahuhan. sana po ay matulungan nyo ako. salamat

Tingnan nyo po sa contrata o yong pinirmahan nyo pong dokumento ng pagkakautang.Kapag po may nakalagay na kahit anong salitang nagpapatunay na ikaw at ang co-makers mo
ay SOLIDARILY LIABLE, ibig po sabihin nun, kahit sino sa inyu pwedeng singilin. At kapag ang creditor (nagpautang) ay pinili nya pong maningil sa isa sa mga debtors o co-makers, gaya po ng pag-deduct sa  sahod, nababawasan na din dapat ang utang. Pero kailangan munang bayaran ang interest bago ang principal.Kaya lang kailangan mo pa ring magbayad sa co-makers mo dahil parang binayaran na rin nila ang utang mo sa coop. Mali po yung sisingilin ka nila ng principal amount ng utang gayung nag.deduct na sila sa mga co-workers mo. Tingnan mo muna kung ang magkano lahat ang naideduct nila sa salary ng yong mga co-makers at i-apply mo dun sa utang. Kapag may balance pa rin, bayaran mo na.

thank you po sa reply. ung amount po na sinisingil ng coop sa mga co makers ko ay equivalent po dun sa amount nung SOA na una nilang pinadala saken. kaya po yun lang ang inaasahan kong babayaran ko. but apparently nga po ay nag dadagdag sila ng interest pa. meron po ba kaung mabibigay saken na article  patungkol dito na pwede kong gawing suporta kung sakali po na magcontest ako sa cooperatiba?

I would rather advice you to settle this over with all the parties concerned, for practical reason. Schedule an appointment with them.  Excerpts of the contract that you presented suggest that your obligation (along with your co-makers) to the coop is solidary. "Jointly and severally " means solidary. With respect po sa interest, if it's written in the contract then you (and your co-makers) are legally obliged to pay at a rate agreed upon in the contract.

Ito po ung mga pertinent legal provisions under the Civil Code of the Philippines for your reference.


Art. 1216. The creditor may proceed against any one of the solidary debtors or some or all of them simultaneously. x x x

Art. 1217. Payment made by one of the solidary debtors extinguishes the obligation. If two or more solidary debtors offer to pay, the creditor may choose which offer to accept.

He who made the payment may claim from his co-debtors only the share which corresponds to each, with the interest for the payment already made. x x x

Good day to all, Im Weny De Guzman
May dati po akong tao also was considered friend na inutusan ko magbayad ng capital gains sa BIR worth 88k last April 16, tapos po tuwing tinatanong ko sya sabi nya ok na wait na lang yung CAR sa BIR, then after a month I found out di nya binayaran, walang record sa BIR at nagkaron pa ng penalty na 36k.
SO wala akong nagawa kundi bayaran ko uli dahil magkakaron uli ng penalty.
Ngayon hinanap ko itong tao ko,at umiiwas na sa akin, nung nahanap ko sya, nangako magbabayad pag meron, pero nagtatago uli sya at lumipat pa ng bahay, pero nahanap ko pa rin.
Gusto ko pong mag file ng estafa sa kanya, paano po ba ang procedure.Sobra po kasing abala at perwisyo dahil nag loan pa ako uli para mabayaran yung BIR.
Pero itong tao mukhang walang balak ako bayaran. bukod don may utang pa po sya sa kin na 35k.
Sana matulungan nyo po ako. Saan po ba ako pupunta para mag file? Dito po ako sa San Isidro Paranaque, nag file pa lang ako ng police blotter pero di ko na po alam ang susunod.

gagatak,

go to the city prosecutor's office, bring with you a copy of the police blotter or any document related to your case, ask fro advice if you can file a complaint affidavit.

If you reside in the same city you have to bring it first to the barangay Lupon Chairman, for katarungang pambarangay conciliation proceeding and ask for certificate to file action.
