Eh pano po ba ang proper procedure para mapaalis ang tenant?kasi po i have the same problem kasi last dec 2009 may nabili pong bahay ang parents ko nakapangalan sya sa name ng tatay ko then alam ko po last january eh nagreklamo sa barangay ang nanay ko dahil ayaw nila umalis then dipa natapos ung usapan sa barangay umalis na sila sa bahay na nabili ng nanay ko without notice the coming jan 2010 napansin ng nanay ko na bukas ang bahay so tinawag nya ang tatay at kapatid ko then pagpasok nila sa bahay eh nakita nila ung tenant na nasa loob then nagkasigawan sila so minabuti nalang ng parents ko at kapatid na umalis then nextday umalis naden ung tenant may kinuha lang ata na gamit so ginawa ng nanay ko eh pinalitan lahat ng kandado ng mga pinto then from there ang tatay ko na at kapatid ang tumira but just last week inabisuhan ako ng kapatid ko na nagdemanda daw yung dating tenant ng bahay na nabili ng nanay ko 4 cases sya to be exact; coertion, trespassing, oral defamation at fixation. tinanong ko po ang nanay ko if napasherif nya ung tenant dati ang sabe nya po ay hinde dahil naden sa kakulangan sa pera at dahil umalis nadin naman ang tenant. ngayon po gusto ko lang itanong ano po ba ang laban ng parents at kapatid ko sa mga kasong isinampa sa kanila?at ang alam ko po ay nde naman dumaan sa barangay ang reklamo nila so papaanong naakabot sa piskal ang kaso?sana po ay matugunan ninyo ang mga katanungan ko maraming salamat po...

If the parties reside in different cities, barangay conciliation may be dispensed with. It is possible that they have moved to another city, that is why.

If your parents were aware that there was a tenant in the house when she bought the property or if the contract of Lease was registered at the Register of Deeds, you are bound by the terms of said contract. That means, you have to wait until the contract expires before you can remove the tenants therein. In other words, the Lease Contract follows whoever is the new owner.

Coercion happens when you force somebody to do something against his will. Oral Defamation is simply "Paninirang puri". Trespass to dwelling can be committed by the owner himself. Indeed, a mere tenant can charge the owner of "Trespass to dwelling". The issue here is not ownership per se but "legal possession". If the owner unlawfully entered the property, the tenant can charge the owner for said offense. Hence, in "Trespass to dwelling", ownership is not a defense.

"Fixation"? I think you are referring to "Unjust Vexation". It is committed when you disturb or irritate the "peace and tranquil living" of a person.

ang alam ko po kasi eh inireklamo ng nanay ko ung tenant sa barangay kasi nga ay ayaw umalis at ang alam ko din po eh tapos na ang lease nila o renta nila sa bahay na nabili ng nanay ko then sabe din po ng nanay ko ay nde pa natatapos ung usapan sa barangay ang bigla naalng umalis ang tenant without notice sa mother ko then bigla one day in jan 2010 nagulat ang nanay ko na bukas ng haws so tinawag nya ang tatay ko at kapatid then dun nila nakita na ang tao sa haws ay ang tenant then nagkaron sila ng pagtatalo para matigil ay umalis nalang sila sa haws at after 1 day ay umalis naden ang tenant so ang ginawa po ng nanay ko ay pinalitan ang lahat n lock ng haws. mali po ba ang ginawa ng nanay ko at ano po ang laban nila sa cases na sinampa sa kanila?maraming salamat po

In that case, your mother was well within her right to exclude them from the house. Just wait for the Subpoena, if any.

meron napo atang subpoena ata kailngan daw nila masagot ang demanda sa aug31. ask ko lang po sana if ano ang mga posibleng mangyare if matalo o manalo sila sa kaso and pde pabang madismiss ang kaso after nilang sagutin ang demanda?pasensiya napo sa maraming tanong worried lang po kasi ako sa parents n kapatid ko dahil medyo may edad napo ang parents ko at parehong may sakit sa puso actaully ang tatay ko ho eh naoperahan na dati sa puso so worried tlga ako sa stress na dulot ng demandang ito at ako naman eh nsa abroad kaya gusto ko lang sana malaman ang mga maari kong ibigay na payo sa aking magulang dahil wala naman po kaming alam ukol sa mga batas. muli maraming salamat po!

If there is already a case, you need to talk to your parent's lawyer. He is in a better position to answer your questions since he is in possession of the full facts of the case.

forclose n po yon property ng friend ko now napagkasunduan namin n bayaran ko yon sa financing in her name at pagnarelis ng title sa name nya saka pa lng km gumawa ng docs para maitransfer ang title sa name ko. at pag me pera na siya at naibalik ang pera na ginastos ko ibabalik ko ang lupa sa kanya. pumayag naman ako. Ano po ba ng mga documents na i pagagawa ko? Marami pong salamat.

if it's foreclosed, do you mean there is already a scheduled auction? did the financing company agree that you can still pay for the loan?

or do you mean she just defaulted on her payments?
