Obliging the Father to Give Sufficient Financial Support to a Son.

Hi Lawyers,

I and my wife has a 2yr.old son and legally married. We lived together after our marriage. Then, as time goes by, we encountered several problems like the financial and misunderstandings, etc. I decided to go and be separated from her because of her attitude of being possessive at all times and in everything. After the separation happened, i never failed in giving my support and providing the needs of our son like Milks, Diapers, Vitamins and even financial in my CAPACITY. The problem is, i received a letter from a Lawyer of the City Public Attorneys Office and inviting me to give an explanation to her client (my "wife") regarding with the following complaints:

1. Not providing sufficient support to my son.
2. Physically and Emotionally affronted my wife. (which is not true, maybe emotionally because sometimes i might say hurtful words against her before). i did that just because of her attitude.

After we've talked, She is demanding me an "amount" i must to give monthly, and her demand is "HINDI KO KAYA" as i computed my salary. My question is, she has the right to demand from me with the exact amount she wants? it is right and legal?

Hope someone can help me by providing advice. Thanks.

your focus should be establishing your defense now in case she files a case. make sure you are giving regular support and you will have the evidence to prove that you are doing so in case she denies it.

Gud afternoon, wuould like to seek help on how to file for a child support...kababalik lang po ng husband ko in saudi last june 2013...nag simula po ang di namin pagkakaunawaan simula po nung nag attend sya ng highschool reunion nila last april.. since then madalas na sya umaga na kung umuwi...then weeks before sya umalis nabasa ko txt nya sa bestprend nya na gusto na daw nya ako hiwalayan at magsasama na daw sila nung girl nya...nagkaron kmi ng confrontation pero di nya inamin binaligtad pa nya ako na ako pa daw itong may lalaki.. 2days before sya umalis kinausap ko sya sabi ko i dont want a broken family.. sb ko kung di n tlga mag work ang relationship namin e magsabi lang sya kung ayaw na nya tlga...ang sagot nya hindi naman daw...sa makatuwid nakaalis sya ng medyo ok n kami...first few weeks nya simula ng dumating sya ok pa nagttxt at tumatawag... dumating ang july araw ng padala wala daw sya suswelduhin kasi nga kadarating nya lang next month na nga daw..so ok lang kasi inintindi ko lang na baka nga walang pera at kinakapos... come on july 2nd week madalang na sya tumawag at magtxt ako nalang ang lagi nagttxt at tumatawag... lastweek ng july wala ng tawag at txt... nagtxt ako sabi ko kung ano ba tlga problema..di sya nagreply.. natry ako tumawag galit pa sya... then sabi ko magusap kami kung ano ba tlaga ang problem...pinilit ko tawagan pero off na cell nya hanggang ngayon... pano po ba ako makakahingi ng support para sa anak ko.. my child is turning 14yrs old... hope un can give some advise

try first going to owwa, hopefully they will contact him.

after that, file a case of economic abuse at the prosecutor's office

Dear Atty.,

Good day!

Would like to seek professional advice. I have a live in partner now and we have two children. But before we live together, he has a live in partner. They have three children. The girl brought the kids in Mindanao because that time the girl wanted to separate with him already. To cut the story short, we are giving our financial support monthly. The problem is, the girl always wanted to increase the amount of support. She always told us, sort of black mail that she will file a case to my live in partner. She will send it to the office of my partner. Ayoko ng gulo at mastress ng sobra ang partner ko kaya ako ang nakikipag usap. My partner signed the birth certificate of hisTWO kids only. He has a good job but we have plenty of monthly dues and pinagkakasya ko lang. I always prioritized the financial support kasi iba ang ugali nung girl. My question is, how much is the average amount to give as a financial support to his sons? Ayoko po kc ng gulo/ filing case kasi nakikipag usap naman kami ng maayos at nagpapadala ng monthly support sa kanila.

charlie, there is no formula used in the ph. try looking up the one they use in australia as a standard

Dear Atty,

another question po... may pending case kasi ang asawa ko ( qualified theft ) may warrant of arrest sya last 2007... kaaalis lang nya noon ng mag issue ng warrant..3 silang may warrant... ang tanong ko po bakit nakakapag renew sya ng passport.. hindi po ba mag appear sa DFA ung record nya? pero ang NBI di p sya nakakapag try mag renew? kapag kumuha po ba sya if ever ng NBI clearance makikita parin na may pending sya na kaso? nagbabalak kasi sya mag resign sa current work nya at mag apply s ibang company pero with in middle east lang din....di po ba panibagong requirements nnmn ang kukunin nya which is kailangan nya mag renew ng NBI...cgurado po ba na may HIT sya....
