Advice naman po at sana matulungan ninyo ako kung ano ang maaari kong gawin sa sitwasyon kong ito:

Dati akong nagtatrabaho sa middle east. At dahil sa krisis napilitan akong umuwi ng pinas dahil 5 buwan nahuhuli ang aming sahod. Umalis ako ng Middle east na hindi tapos ang bayarin ko sa banko. 3 taon na po ang nakararaan at ngayon ay tumatawag nanaman ulit ang bangko sa akin at ngayon ay nagpadala pa sila ng email sa akin na galing sa law office kakasuhan nila ako at maaring makulong ako dahil sa hindi pagbabayad. Maari din daw nilang kuhanin ang properties ko (kung meron man).

1.Tanong po makakasuhan po ba ako ng civilly/criminally? (iyon po ang nakalagay sa sulat)
2. Makukulong po ba ako? sa pinas o sa ibang bansa?
3. Sobrang pananakot sa pamilya ko at mga kaibigan ko. May laban po ba ako? sobrang pang haharass na kasi.

Wala pa akong permanenteng trabaho dito sa pinas at di rin sapat ang kita ko kung idadagdag pa ang bayarin ko sa kanila.

Tulong naman po.

it is not illegal to threaten you with legal action if you do not pay your debts. if they are contacting your friends and family, then that is going too far. you can file a case of unjust vexation, oral defamation or intriguing against honor against the person who did so.

Maraming salamat po. Actually hindi ko alam paano nya nako-contact mga friends ko. Mga kaibigan ko na lang ang nagbabalita sa akin na may tumatawag at nagsesend ng mga message sa kanila sa mga social networking site at naninira sa akin.

Another question Atty, may kaibigan kasi akong accountant sa ibang bansa na advice nya minsan sa akin na magtanong ako kung pwede ako mag file ng personal bankruptcy? Advice naman po.

Pasensya na atty. wala kasi ako idea doon. Kailangan po ba may business ako? wala din akong business para magfile ng bancruptcy. Suma-side line lang muna ako habang nag apply pa. Ano po ba mga requirements para makapag file ng bancruptcy?

Hindi ko naman po balak takbuhan sila kaya lang sa ngayon wala akong kinikita pa at hindi ko sila kayang harapin. Mukhang ayaw din nilang pumayag ng installment na payments kaya sobrang panggigipit ginagawa nila.

you can file for personal bankruptcy. you will have to consult a lawyer to help file a petition in court. good luck.

Atty pwede na po ba mag file ng personal bankruptcy kahit hindi pa sila gumagawa ng action...like legal actions magpadala ng subpoena or court hearings?

bankruptcy can be initiated either by the creditors or the bankrupt person. part of the process is the notification of the creditors and the giving up of all your property to be partitioned between the creditors. if you hide any of your property, you can be charged with fraud.

Thank you attorney. As of now ang tanging property lang na meron ako ay yung lupa na binili ng tatay ko na ipinangalan sa akin ngunit sa tingin ko hindi rin sasapat ang halaga noon dahil wala pang 40sqm yung sukat noon.

Ibig sabihin po ba kapag nagfile ako ng bancruptcy kokontakin ko pa ang mga bangko na nautangan ko sa ibang bansa?

yes, all your creditors should be notified. note that while under philippine law, you will be absolved of all your debts, this may not be true under uae law where non-payment of a loan is considered a crime.

Newbie lang po ask ko lang po kung applicable sa philippines ang personal bancruptcy? they say na only for partnership or corporation lang ang bancruptcy law sa pilipinas.

the current law is the Financial Rehabilitation and Insolvency Act or RA No. 10142 and defines debtor as:

(k) Debtor shall refer to, unless specifically excluded by a provision of this Act, a sole proprietorship duly registered with the Department of Trade and Industry (DTI), a partnership duly registered with the Securities and Exchange Commission (SEC), a corporation duly organized and existing under Philippine laws, or an individual debtor who has become insolvent as defined herein.

so yes, it is possible for a natural person to avail of the law.
