query: if an EE was hired on Oct 2010 and was terminated from work on August 2013. what will be the amount due as separation pay of the person?

Are Agents under a verbal contract of agency entitled to separation pay and 13th mo pay?

the agent ( the management has no control or disciplinary powers over the person of the agent) has not provided substantial bookings/ events for the events company. task was not performed well and the person has become a liability (expenses have been incurred)
