Arresto Menor
May nabili po akong 15,000 sqm (TCT no t1234) na property. bago po nagkabayaran, sinilip ko naman po sa Register of Deeds at wala naman pong problema, pero patay na yung nakapangalan sa tct, kaya subject to Sec 4 rule 74 po sya. Bago pa po ako umabot sa ROD, may mga nagpatayo po ng mga bahay doon sa property... Nalaman ko po na naibenta na pala ng namatay na may ari sa iba ang property. pero nung tingnan ko po yung dox nila, DEED OF CONDITIONAL SALE, na ang subject property ay isang 20,000sqm lot with a diff TCT no. (t5678) lot number 520, ang nabili ko naman ay lot no 520-1. Hawak ko na po ang titulo ng lot no 520-1, at may deed of extra judicial settlement with absolute sale kami ng heirs.
Nakasaad po sa DEED of Conditional Sale nung namatay at ng buyer na bayad na ang kalahati at ang natitirang kalahati ay babayaran ng bumili sa loob ng isang taon. Pero ayon sa mga anak, hindi raw tumupad ang nakabili kaya they went ahead in registering the 15,000sqm portion of the subject (2,000sqm) property in the  Deed of Cond sale) and later on sold it to me. sino po ang mas may karapatan, yung old buyer o ako? i hope u cn help me, tnx po
