My husband was annulled with his first wife. My problem now is that the ex wife has been sending SMS to my husbands mobile phone saying bad things about me amongst other things. At first I didn't mind it (even if it hurt me) but now it's the reason why we fight bcoz he replies (sort of "text war") to save & protect me but bcoz we fight he hides his phone so I can't read their text war & I can't read all the bad textes that his ex wife says about me. My question is, can I sue her for oral defamation, psychological abuse? I want her to pay the price.

At least your husband is taking your side! the fact that he is keeping you away from their war is to stop her hurting your feeling! If you don't read anything she text, you won't get hurt! this is the reason he is keeping you away from their war! Why not let him deal with her? after all you are his present wife and you already won him over her! ignore her, you will see it will annoy her even more if you are not allowing her to affect you or get into your nerves! its called reverse psychology! Do not give her the pleasure! You will see, she will eventually give up.†Wink

Appreciate your reply. I'm there already, my husband is taking my Side but I just want his ex to learn a lesson. She has been doing this for more than a year now. I just want to know if I can sue her for anything? What kind of case can I file against her?

Gud afternoon:)
AWV is correct. Just ignore her. She really wants you and your husband to fight. At mas natutuwa siya kasi siya yun pinagtatalunan niyo. Magagastusan ka lang girl, hayaan mo na siya sa insecurities niya.

@Zyra M. Plata, appreciate your reply. I did ignore her before pa, she's been doing this for more than a year na. What I don't like is what she's texting is way beyond ignoring her. Even if she's not texting it straight to me but klarung klaro na ako yun tinatamaan nya. If asking legal help would make her learn her lesson, I can always ask her from PAO. But my question is, what case can I sue her for & can PAO help me with this?

@HR Adviser, thought so of oral defamation. But can this kind of case be accepted with PAO?

@attyLLL, appreciate your reply. They actually have a daughter & we are both OK, I mean we are friends, we get to fetch her on weekends & spend the weekend with us. I know somehow the ex-wife gets insecure knowing na OK naman kami/ we get along fine with the daughter. Before he promised me that the only reason he "communicates" with the ex is bcoz of his daughter - about school & details about the fetching etc on weekends. But one time I read on his phone some textes from the ex saying "bad, hurting" words, statements about me. I asked my husband, & he honestly told me to leave that matter to him & that sya na sasagot sa mga text to defend me. Pero minsan kung saan saan na umaabot yun mga text nila - all those "bad/horrible" things that happened during their marriage. After a couple of textes nila, it just dies down tapos after a week or a month or so, magsisimula na naman yun ex. I hate it & I want her to learn a lesson. Klarong klaro na di pa sya nkapag-move on & she sometimes uses her daughter. Can I sue her for oral defamation, I really want her to learn a lesson.

You can file a case, but it is more practical to settle the issue in barangay level. Less hassle, less gastos. If she continues to harass you, then bring it to the court.
