Dear Atty.,
I work as an Accountant in a private firm in Makati. Kinasuhan ako ng insubordination ng aming HR Officer sa company. It started when I raised voice at her dahil ayaw niyang pirmahan ang request para i-advance ng company ang SSS sickness benefit ko. Marami daw stamp received ng SSS ang sickness notification form ko. Ayaw po niya ako kausapin at ipinasabi lang niya sa kanyang Assistant na hindi niya pipirmahan ang request. Nag-init po ang ulo ko kaya ako na po ang lumapit sa kaniya hanggang sa napagtaasan ko siya ng boses. Hindi ko na po napigilan ang magalit dahil pini-personal na niya ako dahil natalo siya sa complaint ko sa DOLE nang i-deprive niya ako ng Magna Carta benefit. Ibinawas niya ang 27.50 days absences ko sa aking sick leave. In-order ng DOle last August 28 na i-restore ang sick leave ko. Bukod pa dito, maraming beses na rin siyang napahiya with my reply to her e-mail where I tried to correct false & misleading informations she sends to everyone in the office. Sa tingin ko po na sinadya niyang i-deprive ako ng aking benefits. In-approve na po ng SSS ang sickness benefit ko for 21 days last July 30. Pero nilakad niya sa SSS at ipinabawas ang available sick leave ko kung kaya instead na 21 days naging 6 days na lang. Negligent, incompetent, unreasonable, bias & unfair po ang aming HR. Malakas lang po ang influence niya sa management dahil sipsip siya. Hindi nakikita ng management ang mga palpak at mali niya sa trabaho. Nag-walk out po siya nang pagtaasan ko siya ng boses umiiwas siya sa confrontation. Pagtalikod niya ay nakapag-salita po ako ng GAGO. Pero wala na po siya sa room at lumabas ng office nang sabihin ko ang GAGO. Na-overheard daw po niya ang sinabi ko nang palabas siya ng office dahil na rin malakas ang boses ko. Sa tingin po ninyo valid ground po ito for dismissal? Pinalalabas niya na insubordination ang kaso pero magka-iba po kami ng Department dahil sa Accounting Dept. po ako at hindi ko siya superior. Maraming salamat po sa inyong payo.

imo, this should not be ground for dismissal, but definitely some kind of disciplinary action
