hi everyone..

hope some here can give me advise..

Ito po problema namin..

Tenant lang po kami for more than 20 years siguro,doon po kami nakapagtirik ng house.. pero yong land na yon tenant na din yong grandparents ko..in short, umpisa pa sa grandaparents hanggang sa parents ko..

Yong lupa na yon may may-ari talaga pero sabi nung may-ari yong lupa na kinatitirikan ng house namin, bigay na lang niya, parang inaward na lang niya..ito po problema, bininta nung may-ari yong lupa at sakop yong kinatitirikan ng bahay namin, ang gusto nung nakabili paalisin kami..pwede po ba un mangyari??kasi wala rin naman kasi kaming katibayan na binigay na nung may-ari yon lupa...

wala po ba kaming pwedeng gawin na paraan para di kami mapaalis??saan po kami pwede lumapit??

sana mapayuhan nyo po ako..salamat

so did you try to contact the previous owner? does he now deny the supposed donation? do you pay rent? when was the last time you did so?

is the property titled in the register of deeds? tax declaration only?

matagal na po na panahon na di na umuwi yong may-ari, kaya ang nag-asikaso po nun mga kapatid na lang niya, sila po ang nagsabi na bigay na lang nila yong kinatitirikan ng bahay namin,..tapos po hindi lang naman po kami ang binigyan ng donation, marami po kami kaso nga lang po, yong part na binenta nasakop po yong bahay namen..

ang nagbenta po nun yong isang kapatid lang po, gumamit lang po daw ng SPA, patay na din po yong nagbenta, tapos ngayon po di na po namin alam kung buhay pa po talaga ang may-ari talaga.

wala naman pong sinabi yong nagbenta na paalisin kami,e2 lang pong bagong nakabili na umalis daw kami..

wala po kaming binabayaran na rent since pa sa grandparents ko..

ang alam ko po, wala pong titulo yon, kasi ganun naman po sa province parang minana lang din po ata yon..

Yong bago pong nakabili ang nagpapagawa ng titulo ngayon sa part na nabili niya..

itatama ko lang po, sabi ng papa ko ang magkakapatid daw po ang may-ari ng lupa at wala daw po yong titulo, minana lang din po nila yon..at di pa po nahati-hati yon..

hindi ko lang alam kung pano nabenta yon kasi ang narinig ko po na may isang kapatid na di pa nakapirma, ...at yong nagbenta po, namatay na rin po, iilan na lang ata ang buhay sa magkakapatid..

i'm afraid i cannot bring myself to say there was a valid donation to your grandparents because it is required that it be done in writing with taxes paid. an oral donation is not valid. it may even that your grandparents did nothing to formalize this donation by having the tax declaration transferred to your family's name.

the new owner's first step is to file a complaint in the barangay. you should explore entering into a settlement with them.

i recommend that you try to get a lawyer to more closely review your case. there are many defenses available in ejectment so it is not necessarily that you will automatically lose your case. the worst thing you can do is not participate in the proceedings. good luck.

Attorney, wala po bang batas na pwede mapa-sayo ang lupa na kinatitirikan ng bahay mo kahit ilang taon ka ng nakatira???

Meron po tayong tinatawag na acquisitive prescription. Ibig sabihin po nito, kung matagal na po kayong nakatira sa lupang iyon, pwede pong mapa sainyo na ang lupa. I think it's 10 years or 30 years dependning on the manner of possession. Di ko lang po alam kung mag-aaply yan sa situation mo....

san po namen pwede i-inquire yang acquisitive prescription??pwede po ba kaming lumapit sa DAR???

may mga steps po ba kami pwede pang gawin habang wala pa pong titulo yong lupa??

saan po kami pwede lumapit??

moderator
acquisitive prescription in the civil code has been modified by other laws requiring possession in the concept of an owner since 12 june 1945. the recent free patent act allows application for residential lands occupied as an owner in the past 10 years, but the minimum requirement they will ask is a tax declaration in your name.

Attorney, ask ko lang po..


Halimbawa po, may Title po yong property,tapos po, di po nahahati o wala pang partition hanggang ngayon sa mga magkakapatid, Kailangan po ba pumirma lahat ng magkakapatid sa Deed of Sale??Paano po pag patay na yong ibang kapatid??sino po ang pipirma para sa kanila??

Kung meron po halimbawa di pumirma??magiging valid po ba yong bentahan???possible po ba na matatatransfer po yong property sa new buyer??

Ang unang katanungan ay kanino nakapangalan ang titulo ng property.Ikalawa,buhay pa ba ang may-ari?Kung patay na at walang huling testamento dadaan sa Intestate Estate proceedings.Dapat magkaroon ng Extra-Judicial Settlement with Sale (kung meron). Medyo mahabang proseso ito bago maitransfer sa buyer.

in co-owned property, each co-owner can sell his undivided share, and the sale as to that portion is valid. the buyers become co-owners with the others who did not sell. if a co-owner did not sign the deed of sale or issued a valid SPA, then his portion is not considered sold.

if someone died, then there has to be a settlement of his estate so that his title to his portion can be transferred to his heirs who can now sell to you.

Hi Atty. Meron po akong katulad na problema nito... pero may titulo kami ang problema ang itinuro o ibinigay na lupa sa lolo at lola ko ay iba sa kung ano ang nasa titulo, pero ang lupang sinukat at ibinigay ng dating may ari ng lupa ay ang lupang pinagtayuan namin ng bahay... at ang lupang sinasabi nila sa na sa amin daw ay kanilang ginamit na sakahan sa mahabang panahonh, ngunit nung hindi na nila pinakikinabangan ang lupa kami naman ang pinipilit nilang umalis sa lupa na ang alam namin ay sa amin, sa kadahilanan daw na mali ang pwesto ng lupa namin at ang nasa titulo daw ay iyong katabing lupa namin hindi yung nilagyan nila ng 4 na bato at itinuro sa lolo ko ng kanilang lolo may 60 years na po kaming nakatira dito may mga nakatayong 2 bahay na bato at konteng kabuhayan... ano po ba ang dapat naming gawin? sana po ay matulungan nyo ako.

i recommend that you have your title checked out first by a geodetic engineer to determine the metes and bounds of the title description. if it is indeed wrong, you can wait for them to actually file a case and then assert that you are builders in good faith and they have to reimburse everything you built IF the court decrees that you have to leave. good luck.

i was desperate to know the answers of our problem... wla po ako kilala lawyer....
Sana po matulungan nyo ako mabigyan ng advise or ideas kung anu dapat ko gawin..

Here's our situation:

yun bahay po kc nmin n tinitirhan ngaun pag-aari pa ng lola (maria) ng mama ko although wla xa titulo... but way back 1976 nagbayad ng tax declaration un lolo ko tatay ng mama ko.. (un tatay po ng mama ko manungang lang ni maria) after po nun 1976 hnd na nabayadan un tax... more than 25 years na po kmi nakatira dun.. ngaun taon n 2.. aug 12, 2010 to be exact pinagawan nla ng tax declaration un tinirhan nmin (un mga pinsan po ng mama ko ang nagpagawa ng tax declaration under the name of maria) nagpasukat p po cla sa surveyor.. cnbihan po kmi na hanggang dec 15, 2010
n lng daw kmi dun kc my buyer n cla ng lupa.. pwd pa po ba nmin pagawan din ng tax declaration? nasa amin po yun original tax declaration nun 1976... tapos po ang nkalagay sa tax declaration nun 1976 41 sq. m lang un lot nmin.. ang gnwa nla pinalaki nla sinakop nla un hnd smin kya naging 59 sq. m po un nagreflect s plano... may habol pa po ba kmi dun? anu po ba dapat nmin gawin, parang nauubusan n kmi ng oras... sana po matulungan nyo ako... maraming salamat po! more power..

your first step is to ask that the new tax dec be canceled because it overlaps a pre-existing tax declaration. the older one will be given priority. inquire at the tax assessor's office.

no two tax declarations should cover the same property. you should not leave unless it is proven which one is proven correct.

a tax dec is not conclusive proof of ownership, more so if there is someone else occupying the property.

atty. kami nga po yun nakatira dun for 25years wala po yun titulo only tax declaration lng po made by my grandfater wayback 1976 and now my aunties (cousin of my mother) claiming the said property.. Sabi po nila kelangan n nmin umalis kc my buyer na daw po yun lupa hanggang december 15 na lang daw po kami yun ang binigay nya ggrace period dahil binayaran n nya yun tax under the name of maria (lola pa ng mama ko)... nasa amin po un original tax declaration ng lolo ko..
