jhoy, in what stage of the proceedings are you? still at Preliminary investigation with the prosecutor. what you should focus on is to file your counter affidavit.

i believe your act should be considered falsification, not estafa. either way it is bailable, but dependent on what is actually charged by the prosecutor.

hmm, prelim. investigation pa lang po.twice na po di nagpapakita complainant.. madidismiss po b un kapag di pa sya nagpakita next time? .If i file ko na po counter ko , ano na po bang hihintayin ko after? is there any chance na ma dismiss ang kaso depende po sa ipapasa ko and depende sa sasabihin ng at decision ng fiscal, ?un po kasi ung kaso ko estafa tru falsification, coz they found out receipts with na di nag matched sa original and sa duplicate.. how much po ba ang bail sa estafa and how much sa falsification? - atty. give me figures.. Thank you very much very much..

atty, paano po kaya bababa ng falsification un e, nakastate sa case nang estafa daw po ako? pag nag bail po ba ko di na ko magkaakroon ng HIT sa NBI? saka no need na din bayaran ung amount na sinampa ng complainant?

when po ako dapat magbail? thanks

it will depend on the appreciation of the prosecutor. in fact you should point it out.

if the case is filed in court, it is likely that it will be reported to the nbi.

if you refuse to settle with the company, and you are convicted, you will have to pay.

file bail only if the prosecutor resolves against you.

include it in your counter affidavit, that assuming the facts to be true, the proper charge should be falsification.

one question pa atty, malakas po bA ang laban ko kung i state ko sa counter ko na ang president ng companyang un ay hindi maaring ihabla ako dahil association sila at dapat my board resolution muna galing sa board members bago ako kasuhan.. sa tingin nyo po ba madidismiss ito dahil walang karapatan ang president na maghabla sakin dahil di naman nya personal na pera un kundi ng association?
