Hi good day!

I'm a call center agent based here in cebu. During the earthquake that happend last Oct 15 the company i worked for sent us home and used our vacation leaves to avoid deductions. Those employees who no longer have vacation leaves will be unpaid during that day. The cebu gov't declared a state of calamity the day after. HOwever, several aftershocks were still experienced the following days and still employees had to be sent home again.
My questions are as follows:
1. Is it legal to use the employee's vacation leave during this situation?
2. To those employees who no longer have vacation leaves because it has been accumulated. Is it right not to pay the employee considering we are under state of calamity?
3. i work 8hrs per shift. I only worked 4hrs when the earth quake happend. Is it right for the company not to pay the remaining 4hrs?

for those with no VLs, they can use calamity leave as it was declared to be under state of calamity.

There's no such provision of CALAMITY Leave in the labor, baka mag calamity loan nlng mean mo para may pera.

there is, check with your local government, but it might be for government employees only..
