Hi. Good morning. I have a boyfriend for 11 years and we have been living together since I got pregnant, our son is now 7 years old. But we are not still legally married. Recently, I found out that my live in partner had been dating another woman, they had been together for the last Five years. That woman got pregnant last year and gave birth April this year, and my live in partner signed the Acknowledgement of Paternity which is manifested at the back of the birth certificate of the child. The woman knew all along that my partner and I are still living together, yet she didn't mind. Is there any possible case i can file against that woman? Can I sue her for being in a relationship with my live in partner? Please give me a clear insight as to what I can file in the court against her? Thank You.

case is slight similar to me, ksi o got pregnant din but sa married man which hindi nya sinabi na married siya. the day na nalaman ko nakipag separate ako because ayaw kong maging kabit. to make the story short, ang pwede mo lang gawin ay mag file ng support sa anak mo, kasi hindi naman mabubuo yang bata ng ikaw lang. you can not sue the other woman kasi hindi kayo married nung lalaki. tutal pumirma yung lalaki sa birth cert. nung bata di ba. kung nagtatrabaho yung lalaki sa isang goverment mas mapapadali ang pag file mo. go ka sa PAO dyan sa minisipyo nyo at humingi ng kasulatan ng demAnd letter. gudluck!!

sophia, art 26 of the civil code allows you to sue for monetary damages for disturbing the family affairs of another. i would argue that unmarried parents living together with their child is a family, but there is no decision yet to support this position.

you can file a small claims case. rules on sc.judiciary.gov.ph

Atty. please answer me, what is the penalty for the art 26 of the civil code allows you to sue for monetary damages for disturbing the family affairs of another
