greetings po.. I bought 2 lots in 2003, but up to now the developer is not able release the titles due to their "permit to build" issues with QC hall (and i have no idea why). until last Jan 2013, i decided to refund but they told that process depends on whom have requested first as they are not able to fund all at the same time... and i cannot refund 100% according to them. Even so i waited until the developer informed my sister that i may be able to claim my cheques on July 2013. By the way, I provided an SPA to my sister while away from the Phil. When my sister again follow up my cheques, the developers office personnels are becoming unavailable at all times. Until my sister heard that they are bankrupt and advised all who have asked for refund to convert our property to buy lots in another Village at a higher rate. But i'm not interested anymore to buy or deal with them.

Please can you advise how i will be able to claim my refund. what should i do? I only have Deed of Sale in my hand.

i checked hlurb and saw paragraph below pero with conditions and i hardly understand:

"The said buyer has the option to demand a refund of the total amount paid with legal interest. The total amount includes amortization interest but delinquency interest is excluded. Section 23 of PD 957 Subdivision and Condominium Buyers Protective Decree provides, thus:"

do you think i can fight for this if i get a lawyer? how much would it cost po kaya if i get a lawyer?
