Illegal Termination? (and a number of multiple violations)

Hi there,

Is this illegal termination:

Due to slow down of the project kailangan daw pong magbawas ng tao.

By the time na inaanounce nila ito, dun din sa araw na iyon sila nagtanggalan ng mahigit 20+ out of 60 employees. Meaning no 30-days render. Immediate resignation that day!

Ang mga tinanggal po ay pinaghalong regular at hindi regular na empleyado. Kahit mga maayos magtrabaho (at madalang um-absent ay tinanggal). Sa madaling salita, mahirap alamin kung ano ang pinagbatayan nila sa pagpili.

Babayaran na daw ang isang buwan na hindi nila ipapasok
pinapapirma na lang sila, pero makukuha raw nila ang pera (kasama ang darating na sahod) nila month after, 23 December sa isang ahensiya ng gobyerno. Unethical o illegal po ba ito? (Karamihan ay hindi pumirma at gusto malaman ang karapatan nila)

Hindi rin sasahod sa katapusan (30 November 2013) dahil isasama na raw yung sa huling bayad.

Hindi nagreremit ng SSS ang kumpanya na ito, pero inaawas pa rin at nakalagay sa payslip

Hindi nagreremit ng Philhealth ang kumpanya na ito, pero inaawas pa rin at nakalagay sa payslip

Hindi nagreremit ng tax ang kumpanya na ito, pero inaawas pa rin at nakalagay sa payslip

Alanganin din sila magbigay ng 13th month. Last year po (2012) april na sila nagbigay ng 13th month at sinulatan pa sila para makuha ng mag emplyado ito.

sa labor daw po makukuha yung last payment at sinama pa dun yung sa darating na sahod. meaning walang sasahod this katapusan at december 23 daw nila makukuha. pano po yan sarado na gobyerno nun since christmas vacatio na nun.

pano po yung mga inawas na sss, philhealth, pagibig at tax na hindi naman ni-remit. pano po babawiin yun?

File a complaint at DOLE, demand for mandatory benefits, also file complaint at SSS for non payment of contributions, keep your payslips as reference evidence of deductions.

1. In the event that the company will terminate due to financial incapacity, they must inform both the DOLE and the employees at least one month or 30-days before effecting the termination. You may file illegal dismissal at NLRC

2. The company must pay you 1 month salary or 1/2 salary per month x the number of years serve plus pro-rated 13th month pay

3. With regards to your Gov't mandated benefits, you may file a complaint at the respective offices or if you wish to file a case, you may include it in your demands

I have the same dilema.

5.5 yrs na kami sa company at nare-assign kami sa ibang department. After more than 1 year sa new department biglang nagkaron ng problem at mag sosolo na daw ang department namin. So lahat kami sa department mahihiwalay sa company namin na pinagsilbhan namin ng more than 5 years. Ang masakit nito pinag Reresign kami ng company namin para maabsorb ng humilay na department... at magiging contractual dito.

Napaka unfair samin ito dahil pinag hirapan namin maging regular para maging contractual lang kami. Binigyan kami ng choices:

A. Voluntary Resignation + financial assistance + contractual status for the new company.

B. Seperation pay (1/2 months x 5) at wala ng work kasi wala na daw ibang opening sa ibang department. HR advised us to re-apply.

Lawful po ba ito? Tama bang mag volunatry resignation kami at kung hindi naman ay totally wala na kaming trabaho, na hindi man lang kami na-float.

moderator
it is the company's prerogative to spin-off a portion of its organization.

however, i believe the separation pay should be 1 month per year of service unless the company can prove that it is experiencing financial distress.
