A local has a house and lot under her/his name but local owner wants to pass this to his only child who happens to hold foreign citizenship due to certain circumstances. The local is considering to issue an SPA for the foreigner to acquire the rights of management of the property.

Is this workable?

foreigners who were previously filipinos can acquire land with limitations on size.

a foreigner can also acquire property through hereditary succession.

Hi attyLLL,

Thanks a bunch. What if in case the foreigner who does not have Filipino citizenship, but is actually Philippine native born?

And in case, there are other siblings who have Filipino citizenship but parent's will dictates to have it go the native born, non-Filipino citizen sibling, can he still acquire property through hereditary succession?

Are there law reference articles/readings that we can refer to for such cases?

hereditary law will depend on the citizenship and residence of the decedent.
