Arresto Menor

Nagwowork po ako sa isang BPO company Nagdecide po ako magresign dahil sa attendance issue. Ang last sanction na nabigay sakin is final written warning.  Last month dahil sa forced rdot at everyday OT, may mga times na tardy ako at hindi ko pinasukan yung rdot ko pero nagadvise naman ako sa supervisor ako. After nun, di ko sinasadya na ma-NCNS  nung december 24 tapos ung next week, may forced OT ulit, dahil sa sobrang burnout hindi ko pinapasukan ung rdot at absent ako ng december 31. I know na this is basically an attitude towards work and still under sa policy ng company, this is all my responsibility and insubordination ung ginawa ko.

The following day, I was issued a consequence management for final written warning again tapos may NTE pa due to number of hours missed na pinilt saking papirmahan ng sup q na ginawa ko naman kasi medyo nagkakainitan na kami.

I decided na magfile ng resignation tapos ang sinabi sakin ng supervisor ako na hindi iaaprove ng management ung resignation ko dahil may pending case ako na hindi ba nabibigyan ng sanction. My question is, nasa labor code po ba na bawal magresign pag may pending case like attendance issue? kasi kung wala naman, idederetso ko na lang ung resignation ko sa HR since ganun ung ginawa ng iba nung ayaw tanggapin ng supervisor ung resignation nila.
