I have a client who has bought a property with a right of way at the right side of her property. This right of way leads to another property at the back. The owner at the back didn't pay for the right of way. My client did. My question is, can my client ammend the title and add height limitations so she can use the upper part of the property? Which is logical since the owner of the property at the back will only use the ground for access. Just like in condominiums.
I hope somebody can help me with this. The right of way is not absolute right? It can have limitations depending on the owner's prerogative.
