Hi Atty.,

Maaari po bang magsampa ng kasong sexual harassment ang isang babaeng Supervisor laban sa isang lalaking subordinate (1 position lower sa Supervisor)?

Sila po ay naging magkaibigan at close sa trabaho ngunit sa di inaasahang pangyayari, nagcomplain po ung Supervisor ng harassment sa kanyang Manager laban sa Subordinate noong July 2013. Pinatawag ng Manager ung subordinate at pinagpaliwanag. Hindi naniwala ang Manager na magagawa un ng subordinate at naging maayos ang kanilang pag uusap. Nagkausap din si Supervisor at Subordinate na kung saan nag apology si Subordinate kay Supervisor kung may nagawa man syang hindi nya nagustuhan. Ngunit hindi na sila nag usap o nagbiruan simula noon.

Last Dec 2013, nakatanggap ng memo si Subordinate galing sa office at sya po ay kinakasuhan ng sexual harassment ng Supervisor na sinuportahan ng Manager. Laking gulat po ng subordinate dahil pagkaraan ng 5 months ay biglang nabuksan ang isyu na akala nya ay naging malinaw na.

Pinatawag si Subordinate sa isang administrative hearing nitong January 2014 ksama ang atty ng company, si Supervisor, Manager at HR Manager. Pinatawan ng preventive suspension ang Subordinate.

Papano po maipagtatanggol ng subordinate ang kanyang sarili at ano po ang karapatan nya?
Tama po ang naging hatol sa kanya?
Naging patas po ba ang kumpanya?

The oft-cited legal basis for imposition of preventive suspension is Section 8 and Section 9 of Rule XXIII, Book V, of the Omnibus Rules Implementing the Labor Code, as amended by Department Order No. 9, Series of 1997, which read as follows:


Section 8. Preventive suspension. The employer may place the worker concerned under preventive suspension only if his continued employment poses a serious and imminent threat to the life or property of the employer or of his co-workers.

Section 9. Period of suspension. No preventive suspension shall last longer than thirty (30) days. The employer shall thereafter reinstate the worker in his former or in a substantially equivalent position or the employer may extend the period of suspension provided that during the period of extension, he pays the wages and other benefits due to the worker. In such case, the worker shall not be bound to reimburse the amount paid to him during the extension if the employer decides, after completion of the hearing, to dismiss the worker.

Since sexual harassment po ung kinaso sa subordinate, threat po daw sya sa mga co-employees nya na pwede nya ring harassin kya preventive suspension po ang pinataw sa kanya kc may mga taong hawak si subordinate sa department nya. (Supervisor - 401 level, Subordinate - 301 level, staff under kay subordinate - 201 level)

Palabiro po kasi ung subordinate kaya madaling makagaanan ng loob ng bawat empleyado kaya nga po naging close sila nung Supervisor. After 10 months nilang magkabiruan sa trabaho biglang binigyan ng malisya ng Supervisor ang lahat ng mga biro at ginagawa ng subordinate.

Then specify what actions are being assessed as sexual harassment. Medyo mabigat yan. I suggest a formal apology letter. Wala bang kasulatan kayo ng last time kayo mag usap ? Minutes of the meeting ?

ang batas laban sa sexual harassment ay para lamang sa mga magagandang chicks at cats na pinagpapantasyahn ng mga malilibog na boss na kayang gamitin ang kanilang POSISYON/ kapangyarihan upang mairaos ang kanilang libog. Kung boss ang babalingan ng libog ng malisyosong empleyado na mas mababa ang posisyon, ang armas ng boss ay hindi sexual harassment law kundi ang Batas ng Paggawa (Misconduct) o/ at mga alituntunin ng kumpanya....

Ang kinaso po ng company sa Subordinate ay violation of company's policy on Undesirable Conduct/Serious Misconduct and Behavior:
B.13 Immoral scandalous relationship/conduct (e.g. adultery, concubinage, acts of lasciviousness, exhibitionism) with a co-employee, within or even outside Company premises, during or after working hours.
B.13.2 Scandalous conduct includes any form of physical or non-physical, verbal or non-verbal contact that may lead to sexual harassment.


Ung araw po ng administrative hearing, binigyan din po sya agad ng preventive suspension memo effective nung araw ding po un.

Ang sexual harassment po ba regardless of the position? Kasi po di ba mas mababa po position nung Subordinate na kinakasuhan? Kung Serious Misconduct, pwede po ba syang materminate dahil dun kung wala naman pong katotohanan? Tama po ba naging desisyon ng company? Ano po ang maaari nyang gawin kasi po inaalala ng Subordinate na baka bgla po syang iterminate habang naka preventive suspension po sya.

this is not sexual harassment in the strict sense, but what he did may still fall under serious misconduct or under 2nd par of what you cited.

his defense should focus on whether he actually did the acts which are said to be an offense and his attitude behind it. it is also important to note how the supervisor was acting before, during and after the supposed misconduct.

you haven't mentioned what he did, but it might not be so bad as to warrant termination.

ang complaint po sa report ng Supervisor were the ff:
1. hinahawakan daw po ang kamay nya without any reason
2. telling inaaproprate jokes and conversations about sex
3. hinawakan daw po sya sa bewang hanggang balakang
4. hinaplos daw ang likod nya.

nung una daw po ok lan sa kanya dahil ganun talaga si subordinate. sa loob ng 10 months naging magkapalagayan na sila ng loob at magkabiruan. tpos nag react na daw po sya kc prang sumosobra na kaya nagsumbong na sya sa Manager nya at that time. nagkausap naman sila noon nung subordinate at nag apologize din sa kanya si subordinate kaso after po nun di na cla nag usap. after 5 months po matapos ung isyu, bgla pong naghain ng formal complaint na sexual harassment sa head office si supervisor na ikinagulat ng subordinate dahil ang buong pag aakala nya ay nagkausap na po sila.

  Ano sinabi/ napag usapan . Be  specific . Me witness ba ? Credible ba ? Since nasa iisang kumpanya kayo, if may tumestigo laban sa iyo, tiyakin mo ang bundy card ng mokong na yun. Baka gawa gawa lang para paalisin ka.
3. hinawakan daw po sya sa bewang hanggang balakang.
Totoo ba ito ? Parang too good to be true. Ang boss mo babae, ang isang subordinate di basta basta humahawak, sa balakang pa ? May nakakita ba? Be conscious sa time .
4. hinaplos daw ang likod nya.
Sure ka ba ? Na nanghaplos ka ? Again me nakakita ?  Credible ba ? Madaling gumawa ng salaysay, mga iilang gagong abogado ng kumpanya, gagawat gagwa ng kuwento para lang me mapatunayan, kahit na al;am nila di totoo, kasi pera yun ( Acceptance Fee and Appearance fee pag umabot sa NLRC. For sure yan.
