I just want to ask if its ok for a man to marry again here in the philippines if he was already married someone ( both church and civil) here in the philippines 10 yrs ago, migrated in US and both couple became US citizens then got devorced.

so technically, my question is, is the first marrriage still valid here in the philippines even if they are already devorced in the US? or do they have to file for annulment first before one of them can marry again here in the philippines.

thanks in advance for your response.

Anyone of them can remarry again here in the Philippines without commiting bigamy because they had already obtained a valid divorce decree abroad.

In my opinion the first marriage is impliedly dissolve by reason of that divorce decree validly obtained abroad by a foreign spouse. While the philippines does not recognized divorce, however, it recognizes the EFFECt of that divorce decree.

No need to file annulment before anyone can remarry. Just present the divorce decree and have it judicially noticed.
